  • Remortaging with an interim charging order

    We had started the process to remortgage the house with a view to use for home improvements. We have now received an interim charging order for a debt (from 2013) in my husband's name. The property is owned by us as tenants in common and I have a larger share based on the fact I put the deposit down. My husband does not have enough equity of his own to pay off the debt. Anyhow the amount we are remortgaging for will pay off the debt (although we don't wish to as we don't agree with the amounts they have added on). If we went ahead and remortgaged (it's all been agreed we just need to send off the paperwork) then would they have to pay off the charge using the whole money from the remortgage or just my husband's share of it. Thanks
