we are renting a flat trough an agency. We paid the deposit to them and in the contract it says that it will go to the deposit scheme, but when we tried to get information about it we could not get any. I contacted the deposit scheme and they did not get anything from our agency. Our landlord has changed the agency and now we would like to move out from the flat, it is our last month regarding to our contract. Because we still do not have any information about our deposit we transferred our last rent payment minus the deposit and they says that "I do understand your frustration with regards to your deposit however neither us as an agency or your landlord can take responsibility for a separate agencies misconduct, I do apologise but you will need to send the further £XXX as you have currently underpaid on your rent and unfortunately this is not permitted. ". I think it is our landlord responsibility because I paid to the agency behalf of her/him. I do not think so that it is fair, because it is not our fault that the landlord has chosen a bad agency on a first place.
What should I do with them now?
