  • Premier park Chesterfield parking charge notice

    Hi all,

Ive received a parking charge notice today from premier park.
Do I first go to the retailers to ask for them to cancel it? Its between Tk max and Home bargains but The driver did spend money in both shops.
The driver was parked for 3 hrs and 20 minutes there is three shops there and The driver was shopping with someone and a baby.

    Thank you in advance

First edit your post so that the identity of the driver cannot be inferred. State "The driver....."

    How old's the baby?

Best bet is to go into the stores, with receipts, and complain and get them to cancel.

Can you post up the PCN, with identifying details removed. How long after the parking was the PCN received?

There's also the Range over there so I expect ( if you like shopping) it's pretty easy to get through 3 hours. I know when my daughters go to TKMaxx they can be in there for absolutely ages. There are 3 hour max stay signs up - not sure if you're meant to repark at the Range if you're going in all three shops though... You can try with the stores - go in if you're local and see if you can speak with the manager - the store receipts will have times on, so if they spent an hour in Home Bargains then 2 hours in TK Maxx it should be pretty easy to show by the gap between receipts. Whether their hands are tied by the parking company though is another matter.

The driver was Christmas shopping so must of got carried away shopping. You probably are supposed to move car parks but with a baby in toe it's not that easy. Unloading and loading of said baby probably accounted for the extra time.
Its about 15 miles away but will be trying the retailers first. Just need to find out my receipts for all three shops.

The Notice to Keeper looks compliant with Sch 4 Protection of Freedoms Act.

However, a 'reasonable' grace period should be allowed at the beginning of the parking period (to find a suitable space, read signs etc.)
Plus an extra min 10 mins to exit.
(BPA Code of Practice, para 13).

At this busy time of year, & with a baby to factor in, grace periods should be arguable.

On the 21/11/17 we went Christmas shopping to Stockport. We Decided to call at toys r us before driving 20 miles home, it was dark and raining. Pull in to car park right near the doors to toys r us and was in for 45 minutes ( so the PCN says) never saw the P&d signs. Get home from a funeral on 13/12/17 and there is a PCN on the hall mat. That should of been paid before the 13/12/17 to get it at reduced rate.
I have been in contact with the peel center manager. Who is looking at. From the 5th December it's free parking from 5pm.

That's why I rang them to find out when it started. We also parked at the merseyway and that was free after 3pm for Christmas shopping.

It would seem that most of these parking concessions did not start until early December.
