  • Terminated 2 weeks after raising a grievance on sex discrimination

My contract is governed by Northern Ireland Employment law although I reside in England and work from home.

I recently raised a formal grievance with my employer (I have only 10 months service), and 2 weeks later, my employment was terminated - they said it wasn't a good fit. I'm waiting on a letter confirming my dismissal.

I feel my termination was because I raised a grievance.

What protection do I have here?

If your contract of employment specifically says that it is governed by Northern Ireland employment legislation then that is what will apply.

I am not as well versed on NI employment legislation as that which governs England and Wales but I believe that there is a qualifying period of one year in NI to bring an unfair dismissal claim, however there are certain circumstances in which the qualifying period would not apply such as whether the dismissal could be deemed to be:

    1. discriminatory
    2. for a reason related to a protected characteristic
    3. for a health and safety reason
    4. asserting a statutory right

If your situation can satisfy any of the criteria I have detailed then you may have a claim in the Northern Ireland Industrial Tribunal.

Northern Ireland has a Labour Relations Agency probably similar to ACAS in England it may be worth contacting them to discuss your situation and they may be able to advise on your chances if you were to peruse a claim.
