  • Debt recovery plus co

    Hi guys,
looking for some help with debt recovery plus. I got issued a few parking tickets, only two I hold my hands up to! Now debt recovery plus have said I owe them over £900!
I asked for an appeal and they said it had gone past the appeal date even though I didn’t get letters till a good few weeks after as my car is leased and so the letters when to the lease company before they forwarded them on to me.
They are now threatening me with court action. Can they do this? I will happily pay however I asked for proof of these fines and haven’t received any just parking ticket numbers with amounts. Would appreciate any help!
    Many thanks

    Hi, welcome to LB.

DRP can do nothing but send scary letters.
They are merely 3rd party debt collectors &, as such, have no legal standing re the alleged debts.

First things first: Edit your post so that the identity of the driver cannot be inferred. Has the identity of the driver been revealed, a simple yes or no.

As it is a hire car you will have received a Notice to Hirer/Keeper from the parking company. They do not know who was driving, hopefully, at the time and are trying to hold the keeper (you) liable. The NTH has to have the required POFA statements AND a copy of portions of the rental agreement. This the step that most PPCs get wrong and therefore there can be no keeper liability. Did you get those cpies of the rental agreement? Have you read through POFA 2012 paragraphs 13 & 14?

Oh and ignore DRP Zenith, who have the next desk in the office
