    In other words they have breached the agreement by not keeping to a time schedule which was of the essence.
    That failure has deprived dido of the opportunity to obtain a benefit, and is surely actionable.
    In this case the loss is quantifiable,and therefore perhaps loss of expectation rather than loss of chance.

    However as previously suggested, court action is the last resort!

        I went online to place 10 carefully selected bets, only to find this shit company had failed to deliver what I was told.

        They are liable.

              Just because you think they are liable, doesn't mean a judge will when he hears their defence.

              I think you have an arguable case,(and I might be a lone voice there) but whether or not you can argue it successfully is a different matter.

              If you were to take this to court, it is quite likely that the defendant would employ a barrister.
              It is of course possible to win against a trained barrister, (as we have seen previously on this site), but do not underestimate their skills, nor over estimate your own.

                NEW DEVELOPMENT.

                On Friday we were arranging the cash payment. The man I was liasing with asked which of the 2 bank cards in my account I wanted to use or did I want to add a new one. I told him a new one. He emailed back asking for a bank statement.

                I then emailed back saying I would get it and email it in due course. I then asked when the free bets would be in my reinstated account. He responded the free bets will be in the account today.

                Emailed this morning asking him why my account was still closed - he responded that "as told, the free bets would be placed in my account after I sent the bank statement."

                Utter BS.

                    How does this affect my case? Am I right in saying it is a smoking gun? He has both reneged on the arrangement and shot himself in the foot by lying and trying to put the blame on me.

                            Well, if you decline to give us full details, any advice you receive could be skewed.
                            It could be the T&Cs contain a "get out clause" (they normally do!)

                            Can you show you were never told that you would need to provide a bank statement before your a/c would be reopened?
                            It is possibly a standard requirement which they may claim is either mentioned in the T&Cs or is automatically raised during the phone call.

                              There have been no calls - everything is in writing, and there are no clauses in the T & C that say anything about reopening accounts.

                              Further, I was not told I would need to provide a bank statement before the account was reopened - indeed they only asked for a statement WHEN i said I might want the cash paid into a new account they don't have the details of.

                              Looks like they decided this after telling me the account would be done that day and never told me.

                                FURTHER DEVELOPMENT:

                                They've emailed stating I need to sign a letter they previously sent me before reopening the account.

                                Nowhere in the letter is there a designated place for me to sign. Further, they have only previously asked me to respond to the email the letter was attached to to signify my acceptance of the settlement offer in the letter. Nevr asked me to sign anything. Indeed there is nowhere in the letter to sign!!!

                                Looks like they've realised they dropped a bollock and trying to cover their arses eh?
