ME III Ltd/Nolans Court Papers Received.....

Hi all,

New to the forum so please be gentle...

I have received court papers on Friday by RM recorded delivery.

It is in reference to a Yorkshire Bank loan I took out in 2002.

When things went wrong for me in 2007 I took out a DMP with Payplan and maintained payments for the debt up until the beginning of 2016.

Now it seems they want the balance of approx £1300.

My first question is - will MEIII and Nolans be legally entitled to the balance?

I'm certainly not wanting to hide from it but not wanting to pay parasites if they are not legally due it.

Could anyone please help and advise the very best course of immediate action? We are in Scotland if that makes any difference?

Being in a different legal jurisdiction makes a difference as to how the court procedure works but the Consumer Credit Act is still applicable.

So send a s 77-79 CCA Request to the Pursuer (MEIII) with a copy to Nolans solicitors. This forum has a link to the template here > https://legalbeagles.info/library/gu...etter-example/

It's important to enclose a £1 postal order for the statutory fee.

In order for MEIII to be entitled to the debt they would need to prove it was legally assigned to them by Yorkshire bank.

They've gone down what is called the 'Simple Procedure' for claims under £5,000. I am assuming that is the Scottish equivalent of the Small Claims Court.

Do I have still have time and rights to request the CCA from MEIII and Nolans and do I need to notify the court that I've requested this?
