  • The boat that I brought to live on is not fit for purpose.

Hi everyone I purchased a converted fishing trawler in the autumn of last year which was laying in Bristol harbour, and planned to employ a crew to motor her around the South coast to essex where I would live aboard,to cut a very long story short it turns out that I have been miss sold, and as I understand that in the hope of recouping my money back I have to take the people who sold me the boat to court, this whole episode has left me in financial ruin and unable to take the legal route, any suggestions would greatly appreciated.

Did you have a survey done prior to purchase?

What are the problems with it?

      Private or trade sale?
Was it advertised anywhere with a description stating its condition?

You have supplied no information as to why you feel you've been mis-sold so until you provide a history to the matter none of us can help you. The first question is, what is wrong with it?

Is the trawler brand new or second hand?
As suggested above, what sort of sale was it, business or private individual?
Was there an advert for the trawler and did you get a copy of it?
Did you inspect it? If not, why not?

If you didn't use your credit card to make part or all of the purchase, and you are saying that you are unable to take the legal route, then there doesn't seem to be any other option. Some solicitor firms may be able to come to an arrangement like no win no fee but it is dependent on the facts of your case.

Can't really say anymore until you've provided sufficient information.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

The main problem is with the hull which is wooden it needs at least £20.000 pounds worth of work doing to it to make it sea worthy,i did not have a survey done which i now know i should have had done, because i was taken in by the advert and the sales pitch at the point of sale.

Sorry, but without the answers to questions posed by Wales01man and R0b we can't really advise you.
Also could you post up or give a link to the advert?

It was a private sale, and advertised as not a project and ready to go.

Do you still have the advert, or a link to it?

Wooden hull? Was the boat in the water or on the hard when you saw/ bought her?

Lack of survey and private sale does not look good for redress at the moment.

You might (repeat might)have a claim if the boat is not as described and it was not possible for you to examine the hull at the time of purchase.
However if you were to initiate a court action for £20000 the filing fee would be £1000.
