  • **DISCONTINUED** County Court Business Centre Letter Received

    Good morning Beagles,

    This morning my parents called me to advise me that a letter from the county courts had arrived at their house for me? I have not lived at that address, nor have I been associated to that address for over 6yrs!

    I have attached a copy of the claim to this post, and have gone on to the governments money claim website to acknowledge that I have received the claim, but there is no means for me to tell them I know nothing about the claim whatsoever!

    Does anyone here know what this could relate to, and what the next best action is to counter it, or in the very least, get some clarity as to who is asking me for the thick end of £360?

    the claimant is Civil Enforcement Limited ... I'm sure they do pcn court claims ( [MENTION=5553]charitynjw[/MENTION]?? ) Have you had a parking ticket [MENTION=61850]OliverJB[/MENTION]??

    Also, the PoC says that you should be getting detailed particulars within 14 days ... hopefully you'll know more then xx

      I've not had one that I can remember, and even if i did....I've not been registered at that address since 2011 (minimum!).

      This is claiming that they are claiming damages from 2015, if I understand their letter correctly?

      There is a reference: 4249003487 in the letter. Do you think i should write to Civil Enforcement Limited and ask them to send me evidence of the "offence" to my PROPER address?

      Keen not to let this spiral as i have a mortgage renewal in the pipeline and can't afford to have any black marks on my file

        It's got to be worth writing to them to let them know your current address ... at least then you can find out what it's all about xx

          Before i send it, is there anything i should include, or more importantly omit at this stage? Maybe i should include "without prejudice"?

          I received a call from my parents this morning advising me that you had issued a County Court claim against me at their address.

          This was somewhat confusing to all parties seeing as I have been neither registered, nor associated to their property for over 6yrs.

          Due to the fact that I have no idea what the claim is regarding, and they confirm they have received no correspondence for me at their address over this period I would appreciate you sending this information to my correct address above.

          I have acknowledged only receipt of the claim form with the courts and will await further evidence in due course.

            one last question tho' ... is your car registered to your current address? (they may have got the address of the 'registered keeper' through the DVLA)

              My old car may have been registered there, but that was scrapped a number of years ago! I think it may have even been scrapped before this parking discrepancy is alleged?

              My folks would definitely have told me if i had received letters at theirs, like they did with this and when family had sent birthday cards etc. there!

              One they send me the supporting info I will definitely know more

              Will see how this goes...

                As the POC says they will provide a separate detailed POC within 14 days, that may shed some light when it arrives.

                  if you have a claim then time limit or they get default judgment, another undated POC/ the poc is in the one you got acknowledge on line thru MCOL

                    Thank you. I have gone online and submitted a "Response Pack" to which i ticked 1) I intend to defend this claim, and 2) I intend to contest jurisdiction

                    The second one i was less sure about as there is little or not information that i read that i understood regarding "contesting jurisdiction"!

                    Hopefully this gives me some time to receive their evidence and decide how to proceed!

                      Hi OliverJB you have until 33 days from the date on the claim form to file a defence, which I make to be Saturday 4th November 2017 and as it's a weekend that would mean you need to file before 4pm on 6th November. Hopefully others concur?

                              Just email the court & let them know that you made a mistake re contesting jurisdiction.

                              Put 'Civil Enforcement Ltd v [you] Court claim no [XXXXXXXX] - acknowledgement of service' in the subject box.
                              I normally copy myself in when sending. (Belt & braces).
