    Up to you, if you know the insurer you could contact them to see if you are due any refund from the insurance and then its up to you to decide if you want to pay the GAP back to them or not so that you are only paying a smaller sum of money. Or you could argue that it formed part of the total amount payable and as such you do not need to repay this back, especially if you paid one monthly sum, it is irrelevant how it is broken down.

      Thank you for the advice Rob! Much appreciated.

      i emailed them today asking if they could tell me the insurer which the GAP insurance was with... To which I received a reply stating that after looking further into it, it's not for GAP insurance, it was for the cars 1st years warranty at a price of £500, although I'm paying over £650 back for it. This is the money that GMAC are trying to recover £323 off me.

        Hi,

        so and update on my situation... After sending multiple emails to GMAC regarding collection of my vehicle, a woman from GMAC emailed to say my case would be passed onto Manheim for them to arrange an inspection. This was on the 31st October and I am still waiting. I have showed willing and emailed 5 times asking for an inspection date etc and still no further forward. It's as if I have been forgotten about.

        I intend to fill out the new keeper part of my V5C In GMACs name so that they will be the new owners. It's almost 5 weeks on, my direct debit is cancelled and I'm just waiting for the car to go.

        any advice?

          Nothing I can add except to show that your being reasonable, you should notify them that this is what you are going to do. That way they cannot complain if they incur any fines or charges as a result.

          If it's been 5 weeks since your termination, then you might want to consider putting them on notice of your intention to dispose of the car - there is a template letter at the end in the templates section on the link below.

            Hello again.

            Another update on my situation on GMAC. So I've had my inspection, the inspector was very nice he did find £450 worth of damage, mostly all of that being slight kerb marks, however the car is over 8 years old now! I signed that the inspection had been done however I did not agree to charges etc. Since then Manheim have contacted me to say they have found another scratch and we're going to remove my initial I pectin and create a new one with same damages plus the scratch (which I was not happy about). Today I have received a phone call from GMAC asking for over £700, plus the £300+ for the first years warranty that was all part of the same agreement. On the inspection side of things I was given the report from Manheim with the £450 damages which I have sent to GMAC saying that I was given it. I do agree the wheels are marked, however I don't believe they fall outside of fair wear and tear for the age of my vehicle. Any advice on how to approach GMAC about these charges?

                  Hello, you will need to decide whether you want to argue the charges or pay up. GMAC tend to outsource the recover of these charges to Shoosmiths but doesn't really get anywhere except a bit of back and forth. Always bear in mind there is the potential for GMAC to report a default on your credit file at which point you need to decide if ou still want to pursue it and/or pursue them for inaccurate data given a genuine dispute. I don't think GMAC report defaults and it eventually tends to go nowhere but you need to understand the potential for it to happen.

                  If you have a copy of the report then you can go back on that otherwise dispute what you think is unfair. They can't recover the £300 for the first year of the warranty, assuming its tied up in the total price under the agreement and you weren't paying anything separate for it. Also it falls outside of the limited liability when you VT the agreement as it doesn't fall within the category of what's recoverable.
