    Ok well this is what i think my defense should look like.

    • In response to point 1 of the particulars of claim, i, the defendant, believe this debt to be statute barred under the statute of limitation act 1980. The default date was xx/xx/2011. It is now over 6 years since default. I have requested via a cpr 14 and a part 18 questions to both the solicitor and the claimant, for them to further clarify the particulars of claim, including evidence of 'notice of assignment' and have received no response at all.
    • In response to points 2 and 3, i believe this debt to be statute barred, under the limitations act 1980. I also believe the sum being demanded by the claimant in relation to the statue barred account they reference in part 1 of their particulars of claim to be incorrect and believe this to fall under 'unfair relationship' of which i will challenge. Bank charges, now deemed in law, to be grossly disproportionate and refundable, make up a large portion of the outstanding balance, of which additionally there is interest accrued incorrectly.
    • In response to point 4 of the POC, i do not believe the claimant and their solicitor to have complied as far as is necessary , they have not responded to letters i have sent in which i am legally entitled to a response (cpr 14 and part 18 questions) or acted on phone requests to issue documents requested.
