  • Resolvecall 2nd Home Visit is Unscheduled

    I have an ongoing dispute with my mortgage lender and recently received a letter from Resolvecall in ref to a home visit scheduled for 7th Sept to sort a repayment plan for arrears. So night before I went onto Step Change and completed their debt plan. I gave the field agent my proposal and explained I had already done this about a year via banks solicitors, I then told him the history of my case.
    He confirmed that my vulnerabilities were in his report and the income and expenditure with my payment proposal to pay back arrears whilst also covering the monthly contracted amount aswell.
    Few days later a calling card was in my letterbox yet no one knocked. I emailed Resolvecall requesting an update on the report and they said they weren't dealing with my case anymore. I questioned this as to why? & asked about the calling card in letterbox.
    They came back to me yesterday saying "We work on Lloyds behalf to conduct External Field Agent visits in order to collate information for your mortgage provider. We carry out two visits, the first of which is scheduled and a letter is sent outlining this information. The second visit is unscheduled and purely depends on when our agent is back in the area.
    We are no longer dealing with this matter and would request that you contact..." is this normal procedure in re to an unscheduled 2nd home visit? Plus do I have any rights in seeing the report the agent did? Plus uts 2 weeks since bank had payment proposal yet I have heard nothing. Appreciate any advice whatsoever.

    Good morning

    You do not have to agree. accept any "visitors" who turn up on your doorstep, you do not have to discuss financial date with them.

    You can make a Subject Access Request under the provisions of the Data Protection Act 1998 for all the personal data the creditor holds on you.
    There is a £10 statutory fee for this, however the recipient has 40 days to comply.

      Since this relates to mortgage arrears you need specialist help to prevent the situation escalating into repossession.

      Why not call the Shelter free helpline on 0808 800 4444 they're open 365 days a year.

      Who is the lender (Lloyds?) and what stage has this reached (i.e. how many months in arrears)?

      Have you checked to see if you have any entitlement to help with the mortgage interest from the DWP if you are in receipt of benefits?

      What is the ongoing dispute about?

        Are the bank's solicitors still instructed and was a possession claim issued but perhaps stayed? Or is there already a suspended possession order (hopefully not if the account is in dispute)?

        A lot depends on the reason for your dispute but if this was a regulated mortgage (Residential not Commercial or BTL etc) then you may be able to raise a formal complaint which can be escalated to the FOS.

        You say you were told that your vulnerabilities have been noted in the report so let's hope the lender takes that on board. They should.
