• Caught Shoplifting - Letter From DWG? Help please!

Hi,

I’m looking for a bit of help. Recently I was shopping in Tesco as I always do at my lunch, paying for my items through the self scan service. I was buying a bottle of water, a small pack of chicken and a microwave pasta item. Whilst scanning and paying i was talking to a friend and I got distracted and never scanned the pasta and chicken (these were small items, both of which I had in my hand at the time when I paid). After collecting my water (that I paid for) and receipt I left with my friend only to be stopped by security and I was told the manager wanted to speak to me. The security along with the manager took me to the back security room and explained that I had shoplifted and I agreed and admitted it was a mistake and there was never an intention to steal, I had means to pay and I simply got distracted. I offered to pay but as you can probably tell they were having none of it. Tesco called the police as they believed I was genuinely trying to steal. The police arrived and I explained the situation and they understood and only issued me with a warning (which I thought was fair). When leaving Tesco I was told by security I would receive a claim from a company (I couldn’t remember who at the time as I was focusing on just leaving the shop). I done my research after words and found a few threads on this page about people in similar situations saying they were being asked for silly money from a company called RLP.

However I received my letter yesterday and it is from a company called ‘DWG’ who have asked me to pay £125.00 for security on the specific day? considering the items I ‘shoplifted’ amounted to only £2.50 (I gave Tesco the items back when I was stopped in re-sellable condition), I think this is a bit steep?

The letter states I only ‘owe’ money for security and not for stolen/damages goods and that I need to pay in 7 days?

Do I need to pay this? Is this a company just like RLP (I’ve read in previous threads that the advice is just to ignore RLP) should I do the same?

I would appreciate any help, all this mess over a silly misunderstanding that was never intended!

Thank you in advance!

Hi and welcome
Please do ignore this speculative charge and find somewhere else to shop.
I assume the firm was DWF (not DWG) and they are a large law firm who look to make an easy buck by scaring and pressurising anyone they think might be vulnerable to their tactics.
I appreciate theft from shops is not to be condoned, but do these people have no lee way to give customers the benefit of the doubt.
Goods of £2.50 and they called the police!!! hardly the crime of the century. And can you believe the police actually attended?????
IMO police force should be sending Tesco a bill for wasting police time.

Thank you for such a quick response. Yes it was DWF and not DWG, apologies. I know I thought so myself that the way it was handled was a bit extreme considering the circumstances. However i will ignore any further letters. Do you know how many they usually send before they give up?

Thanks

Sorry, but don't know the sequence or number of letters DWF send.
It is probably as per RLP. otherwise it becomes too expensive for them.
If you could post up their letters (suitably redacted) as they arrive I think Amethyst could add them to our scary letter file http://legalbeagles.info/forums/show...=scary+letters

Re: Caught Shoplifting - Letter From DWG? Help please!

Hi, just a quick update. I received my 2nd letter from DWF, basically saying that i had ignored the first letter and that i still have an 'outstanding balance' of £125.00. This time it doesn't detail what the outstanding balance is for, only refers to the first letter and the date the first letter was sent.

Unlike the threads I've read on RLP who give you 21 days to pay, DWF operate on 7 day payment terms so the time between the first letter and the second was around a week.

I will get pictures posted tomorrow showing the content of these letters.

I guess the advise is still to just ignore these letters?

Thanks in advance.

Hi, just another update. I received my 3rd letter from DWF however this one states that if I do not pay they will consider commencing court proceedings.

I have attached a photo photo of the first DWF letter outlining what I supposedly owe and why as well as the 3rd letter I received today. The second letter is just a replica of the first except it states at the start the original letter and that I have not paid.

I had had to get my brother to send the photos for me as I am in work so I apologise for quality. I will get better photos later but just worried about the 3rd letter I got today.

Are the accusations they make about my credit score accurate? Can this effect my rating? Getting a bit concerned about all this.

Any help appreciated!

They would be hard pushed to raise a claim against you. What would they be claiming for? It certainly wasted for loss as the items were returned. The cost would be more than they could ever hope to recover in the small claims court where claims for legal costs are severely limited (£50). Search for RLP and the Oxford case. RLP got severely spanked by the judge.

You credit rating (and the other nasties mentioned) would only be affected IF they took this to court (very unlikely) and IF you lost and IF you didn't pay within a month.

And ... they'd have to follow the new 'Debt PAP' too (which they can't/wouldn't be able to

Thank you for the advice!

Am am I likely to expect some man turn up at my door to take items from me up to the value of the debt I supposedly owe or is this another relatively empty threat?

I apprecite all the help I have received so far so thank you.

I will I’ll most likely receive another letter next week so I will post it on here if and when I receive it!

Thanks again!

No, they don't send anyone around and just insinuate that they might to scare people into paying up.

Only after a judgement is made and a further court order made can ANYONE come to remove goods from you. These clowns would get hammered in court and they know it.
