  • CCJ set a side

    Hi everyone I am new here and I've been reading through some of the posts and wondering if anyone can help me please.
    My partner had a CCJ from blue arrow and sent off a n244 form to the court which has been accepted. They ignored the request for the information we required so the court has requested it for him. They have until 18th September to send this.
    Recieved a letter from blue arrow today asking him to sign a consent form and they have admitted they cannot get the forms to us or the courts in time. They are asking him to agree to set it aside and file defence within 14 days & no court costs. Court is booked for 2nd October.
    Does my partner need to sign it or are they trying to get more time?
    Any advice appreciated. Thanks for reading.

    Hello, some background to the claim would be helpful, why was the CCJ issued in the first place and what is your reason for setting aside?

    If you requested information and they ignored the request and forced you to make an application then that would have caused your partner To incur unnecessary time and costs and they should at least agree to pay for the costs of the application.

    But that decision is up to your partner to decide whether he is willing to accept the lost costs or if he wishes to pursue it.

      I believe it's an old debt that been sold on. He asked to set it a side as arrow didn't response to any requests etc and the court apparently didn't receive his defence.
