  • Please help!

    Hey guys, this is my first post on here, have recently found myself in a bit of bother. Received a letter in the post from Smart parking Ltd for a PPC, I live in northern Ireland and been told by quite a few people to ignore the 'fine'. Apparently they don't have any jurisdiction over here? Any help is much appreciated! Thanks.

    You've been talking to the right people then. The ability to claim the charge from the keeper of the car (POFA) does not apply in NI and they can only chase the driver. As they do not know the identity of the driver, and you will not be telling them as there is no legal requirement, then they are up that proverbial creek without a paddle.

      I got a letter to the house though? Or is that just because they got my number plate?

        Yes, they got the number plate and got the name and address of the registered keeper from the DVLA. They don't, though, have the identity of the driver. They can only take action against the driver so you will not be identifying the driver at the time will you? The can't, or shouldn't, assume that the keeper was the driver. Just file the paperwork.

          What do you mean file the paperwork? I'm not intending to even contact them so no worry of identifying driver.

            I think what [MENTION=39331]ostell[/MENTION] is saying is keep the paperwork safe for now (don't bin it) but do not respond.
            If they can't ID the driver, they can't legally pursue the RK in N.I. unless they can prove that the driver & the RK are the same person.
