    Hi all
    new to website so firstly like to say hello

    i have just been emailed by car finance to say the second hand car I bought and which has serious engine problems is now my problem as it is wear and tear.

    To give a brief history of the problem
    i picked the car up on the 20th May.
    had it serviced on 9th June and had to replace clutch 2 weeks later 2 weeks later car broke down on the 30 July and had to get it recovered with serious engine problems.
    phoned them to make a complaint and 4 weeks later they sent what they called was an independent company to check the car and after 15 mins he could tell it was wear and tear.and was fit for purpose when I bought it
    the car cost 5,500 pound and I'm now paying for a car I can't use and feel I have been stiched up.
    as they didn't take my view as I believe it was not fit for purpose as there are other issues which I told them but they didn't want to know and have closed the complaint
    the other factors was windscreen sensors not working leaking shock absorbers and brake discs worn to the metal.
    does any one know where I stand on this as I am at a complete loss
    I have only done 2000 miles in the car

    So you now write to them quoting the Consumer RIghts Act 2015 saying you are rejecting the vehicle as it is not fit for purpose and unsatisfactory quality. Post first class and get free proof of posting from a Post Office.

      Hiya thanks for reply.

      my concern is the 247 finance company sent a independent accessor that has stated the car was fit for purpose when I bought it.
      and they are backing that decision and are refusing to take car back on the grounds of no fit for purpose.
      even though the accessor didn't even do a full check or diignostics.
      and also the sensors on the windscreen don't work
      and shock absorber leaking which should have been an mot failure.
      but was not even on the advisories.

        Get that letter sent off so that you don't go over the 6 months. In the first 6 months they have to prove it wasn't defective. A useful life of less than 6 months is not merchantable quality. You have had to replace the clutch, replace the brake pads/discs. You have the bills for replacement?

          Hiya yes have the bills for clutch and also the service.
          Who do I send the letter too.
          Would it be the garage or finance company who i send the letter too.
          As it is the car finance company that has told me car was fit for purpose.

            Send the letter to the garage, the people that sold you the car. You could copy the finance company.

              Just an update of what is happening.
              I sent the letter by recorded delivery and they contacted me to ask what other evidence I have regarding car not fit for purpose.
              I arranged for a proper independent engineer report at a cost of £175.
              And the report states cars big end bearings is not wear and tear and also the problem was there at time of purchase.
              I just wondered what my next move will be.
              As the independent engineer they sent not only missed details but was only there for 12 mins which for a report seems very quick.
              I haven't contacted trading standards or ombudsman yet.
              But have this on record with the consumer advice bureau.

                civic issues

                Hi all.
                i bought a car through a finance company and 10 weeks later the big end bearings went.

                I notified the finance company to let them know and to rectify the fault as i believe the car was not fit for purpose as i also had to put a new clutch in and had it fully serviced.
                They asked me to take it to the garage where i bought it but i reminded them that it is down to the garage to collect and being a long way away.
                They then contacted me to say they would send a fully independent engineer to assess the car and let me know the findings.

                They emailed me with the findings and stated the damage was wear and tear and had been run with low oil and just basically told me they would be closing the case.And i would have to fix it myself.

                Not being happy with the report or the company that carried that out due to links with the finance company i contacted the consumer advice bureau and they told me to send a letter recorded delivery to state the consumer law which i did.
                the finance company contacted me and asked me to supply any information that would counter there claim of fit for use at time of purchase.

                I have just had a proper independent inspection at a cost to myself which contradicts the first report as the proper independent report states car was not fit for use at time of purchase.

                I have a few questions if anyone can help.
                1. Can i reject the car or do i have to offer them to repair which i am nervous about due to the way they have acted and also the reviews they have.
                2.can i claim compensation as i have now been without a car for 8 weeks which has caused a lot of problems as well as paying the finance and insurance and tax for a car i cant use.
                3.If i do have to offer them to repair the car how long would be acceptable for the repair as i do not want to go much longer without a car.
                4.I am also unhappy with the way i have been treated could i complain to Trading Standards/ombudsman.
                5. Is it worth getting a solicitor and if i win the case do the finance company have to then pay my fees.
                sorry for the long thread i just wanted to be clear as to what has happened so it gives a true picture.
                Any advice very much welcomed.

                  Hi and welcome
                  1) You requested a repair, which they have refused to do.
                  Therefore you can reject the vehicle.
                  Te claim that it is wear and tear is no defence for them.
                  If a fault is detected after the first month during the next five months it is deemed to have been present when the vehicle was purchased.
                  It is for them to PROVE otherwise
                  2) yes, you can claim damages
                  3. See 1 above
                  4. complaints to TS have to be via CAB, and IMO it is a waste of time
                  5. I would not engage a solicitor.
                  Assuming the vehicle cost less than £10,000, any action is most likely to be allocated to small claims track and claimable costs are very limited.
