  • Lowell Ccj threat

    Hi I need some advice please. Lowells have been sending me letters for a while now but from what I read ignoring them was the best course of action, but now after coming back from a 2 week holiday I have a letter asking me to contact them to make arrangements to pay within 2 weeks otherwise it may result in a Ccj.

    Now the story go's like this, it was 2011 when the Somalian pirates where hijacking the ships and I was in a position to get a job working as a ship security officer and earn some good money for my family. My son was 3 at the time and because I was expecting to be away for 3 months at a time I got talk talk Internet in so I could see and speak to him and his mam across the Internet. When I started work guarding the ships it immediately became apparent that this was not a safe or organised company to work for so I went home after the first transit.

    When I arrived home my girlfriend told me see couldn't handle this anymore and we split up. My son came to live with me, she went off the rails drinking all the time and someone ended up getting stabbed at one of her house party's before she would sign my son over to me even tho he was living with me anyway. At some point between splitting up and getting full custody I rang talk talk to see if I could cancel the subscription and explained the situation to them but they wouldn't have it and I agreed to pay the rest of the monthly bills until the subscription ran out. I am fairly certain I did pay the last bill and I thing the problem has came when they wanted the router back. I never received any letters or anything asking for it back becauseI assume they were sending them to me ex partners house. 6 years on and the charges and what not have amounted to £181.

    Do I have to pay or is this not my fault? A quick reply would be appreciated because I have until tomorrow to decide :-/

    I have only just seen this, so I don't know whether you answered the letter, but it seems like a pretty standard scare mongering letter. The only way you could have a CCJ is by them taking you to court and winning a judgement against you, then you not settling the judgement of the court within 28 days of the order sent out by the court. They can't just decide you have one because they wrote to you.

    Whether they'll proceed to court is questionable, however I'd be minded to advise you to check when the last payment you made to them was. Order a bank statement for that year to get the exact date, because if it was in 2011 you are running close to the debt being statute barred (meaning they can't claim through court anymore).

      Hi thank you for the reply, I didn't end up getting in touch with them. If it comes to it I'll check when my last payment was as u suggest. Thank you for the advice :-)
