  • Sold a car privately

    Hi I need some advice. We sold our car privately, we had no problems with the car prior to sale but unfortunately the buyer had issues with the clutch soon after the purchase. (It was a mini and they are very well known for clutch problems) The guy is trying to get money out of us, and threatening to take it to small claims court. I have spoken to Trading standards and they have said we haven't done anything wrong and he has nothing to pursue us with. But I'm still worried. Any advice welcome, thanks

    As this was a private sale then caveat emptor, buyer beware, applies. As long as you didn't make misleading statements then it is their problem with the clutch. You may feel that you may want to contribute to the cost of any repairs but this would only be out of the goodness of your heart as there is no compulsion to do so. The threat of small claims court is just a frightener to try and get some money out of you. Any judge would just laugh it out of court, and probably give you some more than normal costs for the most unreasonable case.
