  • Debt Collection and CPUTR 2008

    I am at the moment dealing with a debt claim and am very unhappy how my requests for further information and clarifications are being dealt with. I am considering sending a request for info under CPUTR 2008 as I believe their actions may represent an unfair commercial practice which is impairing my ability to make an informed decision before entering any contract.
    Can anyone advise if debt collection companies (Lowell) and their solicitors are bound by CPUTR 2008 or do they have any exemption from these regulations,
    Any case law on this?

    My understanding is that although they may not be obliged to answer your questions they are not allowed to lie if they do.

    I remember sending several letters under CPUTR asking creditors if they had the original credit agreement, not all replied but one nice kind firm with my biggest debt replied saying they didn't have it.

    What exactly is it you are trying to find out, offering an opinion is very hard without the full story
