  • Car trouble

    Hello

    Hope someone can help.
Bought a car from a local business. 11 years old costing £3995. On finance. Bought on the 12/08/17
One week later would not start. Owners came out eventually got it going saying if it happens again let them know see if they can sort it out etc...
It did happen once or twice but I got it going. About four weeks ago it started to loose power and also mis fires. Explained to garage owner they said they will get there mechanic to look over it. This was three weeks later!
Mechanic is an ex Audi specialist and fault is injectors. One injector is at 0% the other 3 are at 40-50% he advises to change all four injectors. Garage owners dad calls tonight in person to explain they are be prepared to pay for one injector the whole bill for four to be repaired is £1300! He said we could of just got the one repaired and not mentioned to you about the other three but we thought it be the decent thing to tell you about all four! (Play on words, salesman talk?) The warranty in place only pays out if injectors break report from testing says wear and tear so insurance won't pay out. He did say about taking the car back and putting it in auction but I can't see us getting full cost of the car back at auction. He says he's already out if pocket in the car!
One week we had the car and all of a sudden the injector has worn bearing in mind one injector is at 0% so that won't of happened within a week
The car had 7 months MOT left full service history etc. Advertised as a nice car blah blah.
I'm so sad and annoyed as my last three cars were bought private and no problems.
We are going to see the mechanic tomorrow but garage owner away on holiday and so is his dad who's been left to deal with it.
I've had no car since tuesday.

Please can anyone give us some advice on what we can say or do

    Many thanks

    Re: Car trouble

Can you verify the dates you gave, your description doesn't quite tie up.

If you have had the car for less than 30 days then you must write to them and tell them you are rejecting the car under the short term right to reject of the Consumer Rights Act 2015. That's why I asked about the dates. If it's outside the 30 days then you still have the right to reject, especially as they have tried to fix once.

When you write either send signed for (though I have no confidence in that system) or first class post and get free proof of posting from a post office.

      Re: Car trouble

      Thanks for the early reply.
Sorry, I put the wrong date when I purchased.
      Purchased 12/06/17
Wouldn't start and the garage salesman called to look at it and got it going in the 18/06/17
I experienced the same problem and also in the 30/07/17 it began to lose power. I messaged them on the 31/07/17 to explain they messaged back saying he would arrange to have it looked at when he returned from a trip.
The car finally went in to be looked at on the 2/8/17 till 4/8/17
The mechanic explained he thought it was injectors etc..and it finally went in this week on the Tuesday they still have it apart awaiting my decision whether I want the work to go ahead and pay the difference but like I said he mentioned taking it back and putting it in auction but I'll loose either way.

      Thanks

        Re: Car trouble

So you will definitely be rejecting it for unsatisfactory quality, not fit for purpose and possibly not as described if you have a copy of the advert. You expect you money back in full, though there may be a deduction for use (what use!) of the car. The other option, of course, is that they agree to fix it without charge to you. You have 6 months to reject when they have to show there were no defects as a reason to refuse the rejection.

It's up to you what you want to do but they cannot just wipe their hands of any responsibility. If you want to get rid of the car then write that rejection letter now. You must post it rather than deliver it by hand so you have proof that it was sent. Mention the Consumer Rights Act 2015 in any letter you send.

Picking up the car at no cost is not a problem as they already have the car. I don't think it is going to be a problem showing that the car was of unsatisfactory quality given the history so far.

Put your letter on here first for critique if you want.

          Re: Car trouble

          Thank you.
I've just spoke to the garage owners dad as son is away.
They have an official report on injectors one is definitely broke, one is it could last 3/6 months and it would need fixing the other two are running at an acceptable boundary. They are offering to fix the injector that is broke but want to know if I want the other three replacing at my cost.
They are saying it's wear and tear and it's just like having a bald tyre and I would be responsible for that. Is this a load of rubbish they are spinning me.

          Thanks

I have not got the advert. But got a road safety check list from them
They are saying well the car has done 114000 miles you didn't buy a new car you bought a second hand car

          Thanks

            Re: Car trouble

Even with a second hand car you have a reasonable expectation that it will last longer than the 1 week initial problem and the problems a month after that. I would write that letter rejecting the car under CRA 2015 and see what they offer in return. Be prepared to start court proceedings in the small claims court.

I presume the road safety check list was done by them, ie not worth the paper it is written on.

                Re: Car trouble

                I can suggest:

                Dear Sirs,

                Ref car number xxxxxxx

This car has had numerous problems since I purchased it on the 18th of June this year. Because of this I consider that this vehicle is not of satisfactory quality nor fit for purpose. I am therefore rejecting it, as is my rights under the Consumer Rights Act 2015. I expect the refund to be received within 14 days, as provided for by Chapter 2 (20) (15) of the legislation.

                Yours.......

Send by first class post and get free proof of posting from a post office. The letter is presumed to have been delivered within 2 working days.

                  Hi

                  Just a quick one.
I was going to see the mechanic this morning to look at the report of the injectors and get a copy is this advisable?

                  Many thanks

                    Re: Car trouble

There is no reason not to see the report. It may just help your case.

                      Re: Car trouble

                      Hi

So glad I went to mechanic he's an Audi specialist too. I've got the report and two injectors are faulty the other two are not even the part for the car they are a part made before even the car was!
The sales guy has been argumentative with the mechanic and told him not to show me the report. Mechanic Says he's trying to cut corners and he won't put his name to the job to cut corners. An honest mechanic
So I'm in the process of writing my letter

                      Thanks

                        Re: Car trouble

So I take it that you will be rejecting. Make sure you keep that paper trail.

So that's a garage to avoid in the future.

                          Thank you!
