  • Postponing Court Date to Allow Negotiation

    Is it possible to ask the court prior to a hearing date to postpone the hearing to allow the parties further negotiation?

    If so, do you simply write to the court to request the change of date?

    Yes you can ask the court to stay proceedings - whether they'll allow it or not depends on a number of things.

    You would need to make a formal Application unless both parties are willing to consent to a stay (or an Adjournment)

    Is this a claim against you and do you need any help with it or have you successfully negotiated a settlement (since August)?

      Hi Diana, this one is a claim against me and there is another thread on it entitled “Unjust Enrichment.”

      No no settlement has been reached, I’m awaiting the directions questionnaire and/or reply to defence from the claimant.
