  • MadMartAgyn vs Local Council & Hospital?

    Hi

about 16 months ago, my 74 year old mother-in-law tripped on the pavement in our village and broke both shoulders! She spent 5 weeks in hospital, and a year with physio, before a new consultant expressed his disgust with her original treatment and told her she would need an operation on her left shoulder, which she should have had the day after the accident.

She is now thankfully recovering, but still cannot dress herself let alone drive. She lives alone and carers visit twice a day to help her get up in the morning and go to bed at night.

The pavement is not in a good condition where she tripped, but I really don't want to go to one of the ambulance chasers for this, as they want something like 30% of the claim. I've looked on the Council's website, and there is something there for solicitors to submit claims, but it only works for claims up to £20K, and I feel that she deserves more than that (if we can prove they are liable). (I am JP, and with two broken shoulders, with the length of her recovery would entitle her to more than that in my court)

The original treatment by the consultant appears to be questionable, so there may be a claim there as well.

    Any advice?

    Thanks
    Martyn
