  • Investigation/Disciplinary

I hope someone can help me.

I am a registered nurse. I have just attended an investigatory meeting as an allegation has been made that I instructed staff members to do something which unbeknown to me is against the rules. I did not instruct them to do this but did know it had been done.

I am now being told that it is likely to go to disciplinary and they are calling it gross misconduct.

I have been with the company for only 3 months and have had no training or supervision since I've been there.

My question is how likely is it that I will be dismissed?

    I would appreciate any replies

      Re: Investigation/Disciplinary

Is the instruction you gave something you would have routinely requested other staff members to do in previous jobs as a registered nurse you have held?

If the issue does go to a disciplinary then the issue of lack of training or induction since you have been with the company is something that should be a point that you can make at any disciplinary hearing in mitigation of the allegations they make.

As to whether they can dismiss you it depends on a number of factors, the severity of the allegation, whether they take any mitigating evidence you present into account when reaching their decision. There is also the fact that you have less than 2 years service and as such employers do feel they are "less at risk" of dismissing an employee although there are circumstances where this is not the case.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do my best to provide good practical advice, however I do so without liability.
