    Hi ,

    The debt was roll over that i took out 2015-2016 with Lending Stream i took out three loans with Leading Stream but the payments become unffordable due paying off other payday loans and the loans were increasing in size.

    Now Asset Collections & Investigation send me a Claim form I have Acknowledge the Claim, my question is that should I send off the CCA, CPR 31.14 and CPR18 or should I send a letter to the Asset for Unffordable payment letter and where to start and any help will be great.

    Is this just for one loan? Or did you default on all three? Had you borrowed from LS before this one?

    You were also borrowing from other payday lenders - who were they, did you borrow repeatedly from any of these? What was your credit record like at the time you borrowed from LS?

    (These questions may seem irrelevant but they aren't!)

      My credit record was very poor rating at the time when borrowed from Leading Stream, I borrowed from Safetynet and Provident and defaulted I have some mail order debt aswell. Yes I default on all three

        ok, do you know how much you owe in total to SafetyNet and Provident? And to any other lenders?

        What is your current situation, are you making any payments to your debts? Can you afford to make any?

        HAd you previously borrowed from any payday lenders and repaid the loans?

          not making any payments at the moment due to low income and I think total for any payday loans were £1300 including Lending Stream, yes I paid settled then "Roll over" debt

            I have just send off CCA, CPR 31.14 and CPR 18 aswell, as time is ticking do I need a letter to send them about Affordability Complaint as I could not afford to pay the payday loans. Thanks

              You can put in an affordability complaint but you need to understand that it may be a struggle to get the court action suspended whilst the affordability complaint is considered. See https://debtcamel.co.uk/court-payday-loan-debt/.

              Also if you didn't have previous loans from them that you repaid, you may not win the complaint.

              I'm not saying don't do it, I just want you to be realistic.

                Yes i did have previous loans with them but they were payed on time, I made about 4 full payments with Leading Stream this come out the blue with court claim no action before letter i received just the court claim Im now sure what to send to them?

                  Get an affordability complaint in about all your loans then - with previous loans repaid, you may get some money back from them!

                        All so I had other payday loans and they kept giving me a roll over I was paying off the other loans to meet the next loan, even thought I had poor credit rating as well.

                          Affordability complaints go to the original lender. Do this for all your payday loan you think were unaffordable - hopefully you will get money back from some of them.

                          If a debt is with a debt collector but you haven't yet had a Claim Form, tell them you have put in an affordability complaint to the original lender and ask them to suspend enforcement action until the dispute is resolved.

                          For this AC&I Claim - [MENTION=6]Amethyst[/MENTION] other people will have to step and and talk about
                          - the default notice issue
                          - whether the Claim can be suspended pending resolution of a complaint to the original lender, probably going to the Ombudsman (see https://debtcamel.co.uk/court-payday-loan-debt/)
                          - a potential Unfair Relationships defence
