    How long can a company legally adjourn a stage one meeting for absence?

    I had a meeting in June which was adjourned pending O/H referral and I have heard nothing since. I am now told this will hold me back for a transfer to a new department as this is classed as a pending disciplinary.

    Is there any legal timescale in which the meeting becomes null and void?

    In answer to your question there is no legal time limit in which the meeting becomes null and void although any question of this nature would be based on reasonableness.

    If you have had not correspondence in regard to the likely timescale that the meeting will be reconvened then I do think that is a bit strange. Even if they are still waiting for a O/H referral and this has been delayed for any reason they should have notified you of this.

    I would suggest that you email/put in writing a request to the person who conducted the meeting asking for any update on the O/H referral and the timescales for when the meeting is likely to be reconvened.

          I have just spent 30 mins on the phone to a mate who is a team manager for another department who is disgusted at the treatment I have had this week alone.

            I understand that this must be really hard.

            Did you ask for the transfer before you were asked to attend the meeting for a stage one absence hearing?

              yes, I have been asking for a transfer for 12 months.

              I have had 3 instances of sickness, first one was due to flu, I worked until I couldn't get out of bed anymore and had 3 days off (which didn't include 2 non working days) and just lay in bed feeling crappy.

              second one was due to a cyst brought on by hypermobility, I was calling them every 2 mins from the hospital and had 1 day off due to not getting discharged until after my shift ended.

              third occasion was due to a chest infection where I had 2 weeks off because I physically couldn't breathe! I went back for 2 hours and they stopped me 1 weeks money (paid me for the 1st week not the second) as they said this was 2 occasions of sickness.

              I have worked in Customer Services since I was 17, for the same company (on and off) for nearly 4 years and have never failed DPA. In 3 months they say I have breached it 3 times. Today I was told I had failled it at 5pm and was in a meeting at 5.03! Literally I had time to listen to the start of the call and was taken in to the meeting!

              I am being told I am going to a stage 1 hearing within 72 hours (that will be good, I am on holiday for 9 days come Monday!)

              Seems odd this follows a complaint to our internal union that I still, hadn't had reasonable adjustments or a timescale for transfer.. and I'm not the only one!!

              Another member of my team had a hearing for absence when she asked about a transfer too and they have confirmed this would make you ineligible to move!

                UPDATE: Occupational Health referral for 16th August 2017 (same day as I have said disciplinary for failing DPA) not bad seeing as I have been waiting since June for a telephone call and now have to traispe in to Sheffield for a face to face appointment! Not impressed!

                I am also very unhappy cos all this is so I can get specialist equiptment I have been waiting 19 months for, another woman asked for help in June and has a risk assessed desk by August! Without referral or argument.. so my question is why should I go to bloody sheffield at my own expense to get stuff I was told they had last (as in 2016) april?!?!

                Still no update on the transfer, however my manager is being transferred (against her will) to another department and all us part timers are being disbanded cos our unit isn't taking on any more part time staff!

                Now.. am I the only one thinking it's a bit bloody convienent that I have a disciplinary that could stop me transferring and mean I would want to leave totally when they are looking to not recruit part timers????

                I feel I am being managed out the door, and I don't feel i trust anyone, even OH! I am scared they are going to say "Oh, she's not as bad as she says.. get rid of her!!"

                Totally paranoid now I know, I just feel that this unit is out to get rid of part time staff totally!

                  UPDATE:



                  Occ Health appointment.. sorted.

                  Walked in and he did all the relevant tests, he agrees I have absurdly flexible joints and deformities to my upper joints. He then took a load of information about my personal circumstances, did it affect me dressing, cooking etc and has sent a nice little letter saying I have a severe disability which will cause me incredible levels of pain and that they need to pull their fingers out and sort out the equiptment... PRONTO!

                  He also said they had wasted my fuel and time sending me as my disability was obviously not a cause for a chest infection (and told me to give up smoking.. I know.. i know!!) and that they need to "stop playing silly buggers and do their job!"

                  He also told me to tell them I was not attending that afternoon because of pain levels and if they don't subside today.. stay home again!

                  I think I have a new favourite person!
