  • orange bill being taken to court need to defend by 30th July

    arrow global has served court papers on me
    I do not remember having a debt with orange if i did it was around 6 years ago. I do not even remember the amount, how to i complete defense.
    i did receive letter from arrow global several months ago chasing debt. I informed them that i am not aware of debt
    they still kept writing to me. i need help to defend this claim please

    First things first, have you acknowledged the court claim?
    When was the claim issue date?
    Could you post up, or write verbatim, the Particulars of Claim? (Obscure your personal details).
    Approx how much are they chasing for?

      I have not acknowledge it yet i received it on the 3rd july the issue date is the 27/6. I was going to acknowledge it tomorrow.
      the debt is 680 .00 for phone bill.
      i did have a old ------ bill in 2010 but i dont recall that amount outstanding

            Ok, so you have 19 days from the claim issue date in which to file an acknowledgement.
            For now, defend in full.
            Do not contest jurisdiction.
            Do not put any dialogue at all in the 'defence' box.

            As this is for an alleged Orange mobile debt (now EE), it is unlikely that the Consumer Credit Act will be applicable.

                  ok the tread is working now, am not good on computers.
                  I have filled in form on MCOL and sent it in.
                  what do I do next as you have said the consumer credit is unlikely as its a mobile bill.

                    We would suggest sending a CPR 31.14 request* to the solicitor for disclosure of documentation & a SAR to the original creditor.

                    *If you need help with this, we would need you to post up a copy of the Particulars of Claim (or write verbatim), obscuring any personal details.

                        Ask for
                        An accurate copy of the original agreement including all relevant Terms & Conditions, plus any subsequent variations.
                        A copy of the Notice of Assignment.
                        A copy of the Deed of Assignment.
                        A detailed breakdown of the alleged sum as claimed by the Claimant.

                        Scrub the bit in red referring to the CCA.
                        Add 33 calendar days to the claim issue date to give you the deadline date for your defence.

                          when you say add 33 calender days to claim issue. Do i add this information to form or its just for my information.
                          also do I use the link letter and delete the red bits
                          so is it a matter of just copying letter and putting in my relevant information

                            From the CPR 31.14 letter
                            To enable me to file my defence and/or counterclaim, I require inspection of documents you mention in your statement of case ahead of filing my defence on xx/xx/xxxx.

                            Yep. The red bits re the CCA.
                            so is it a matter of just copying letter and putting in my relevant information
