  • DCA chasing probably statute barred HSBC credit card and overdraft

    Hi all. I have made my first post recently on here and I'm starting to get a feel of the site so hopefully I am posting this in the correct place this time.

    I am being chased up by a DCA (Capquest) regarding a couple of old debts with HSBC. These debts are:
    •A credit card
    •An overdraft

    I have wrote to HSBC recently with a Subject To Access Request. I have been going over the mound of paperwork that has come back from HSBC today. It appears that the debts I am being chased up defaulted between May and July 2010.

    I may have made token payments to Metropolitan acting on behalf of HSBC for a couple of months from memory but am unsure of exactly how long i did this for.

    •Can I therefore assume that both are statute barred?
    •Would you send Capquest statute barred templates?
    •Does statute barred apply to overdrafts in the usual way?
    •What would be my best move at this point? Should I make a CCA request before making any statute barred claim?

    Capquest have repeatedly ignored my requests for the status of both accounts
