  • Joint accounts?

    Hello all, just a question if I may.
    My wife and I had a joint bank account and therefore a joint overdraft, now that it's in the hands of a dca they are trying to claim the full amount from both the wife and I separately even though we live in the same address? They were only chasing me for it at one time until I came to my senses, my wife has not at any time acknowledged the debt as we think that it's incorrect that the DCA should chase both for the full amount. It's not like they've stopped chasing me nor have I stopped correspondence with them, so the question is is this correct?
    I could understand this action had my wife and I been separated and living at different addresses? Although I do wonder if we were at different addresses and not on talking terms the DCA would claim the full amount twice and possibly get it without the other party knowing?

    Each holder of a joint bank account is liable for the full amount, so the creditor is entitled to request payent from either one or both for the full amount.
    However they can only collect once the amount due, and any over payment must be refunded.
