    Hello guys,

    My mum who is a long term member suggested I post here for some advice in a rather complex situation with a close friend of mine.

    Sorry if I ramble I'll try to be as detailed as possible.

    My friend suffers from some personality disorders and depression. She took a massive overdose 2 weeks ago. She was in a coma for 4 days ish. And I'd currently being assessed for any lingering brain damage.

    Because of her brain injury her memory is completely shot so we can't get many detailed answers from her.
    Anyway, her company ha's now been taken over (since she has been hospitalised ) by another company.
    Her mental health situation means we don't want to burden her with this but we want to protect her.

    She has been with the company around 2 years. I'm not sure what her contact details are or how long it is but believe she is permanent. I don't think she is in a union.

    She will probably be off work for some time.

    I know it's all a bit vague but can any one give me an idea of what we can expect?

    I am sorry to hear about your friend and hope that she is starting to make a recovery.

    If her company was recently taken over then it is likely that your friend will already know about the situation since this would be covered by the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) and there would have been a consultation process leading up to the new company taking over.

    Do you know whether the "old" company was aware that your friend was off sick and if so they should have informed the new company on the date of transfer of this fact. However now that she has been off for more than 7 days in a row including weekends she needs to provide the "new company" with a Fit Note from either the hospital doctors if she is still in hospital, or if she has been discharged then is should be from her GP. Her entitlement to sick pay will be in accordance with her contract of employment which will be the one she had with the "old company" as her terms and conditions of employment would have transferred across to the new company.

    This is just a very broad explanation at the moment with the limited information, however we will be here if there is anything further or more specific you need to ask.
