    Hi can anyone help me as im a newbie and not sure how to act or whoch way to turn.

    Today i received a letter in the post from northampton about a ccj claim is going against me from asset investigation and collections on a debt 4 years ago originally from lending stream for 759.

    I had trouble at the time paying the rolled over loan from lending stream and after a while i heard nothing from them.

    I recieved a letter about a year ago from asset investigstions saying they now own the debt however because i never received anything in the post from lending stream i ignored it. But today got a letter from the courts saying i have 14 days to act.

    Any suggestions on how abouts i can go wbout this. A ccj will really harm my credit file but at the same time cant afford to pay what they are requesting, any help would he much appricated.

    Hi Sonics2012, welcome to LB.

    If you are sure that it is a bona fide court claim, you do need to acknowledge it within 19 days of the issue date, or risk a default judgment.
    For now, defend in full.
    Do not contest jurisdiction.
    Do not put any dialogue in the defence box.
    This will buy you some time to figure out a strategy to deal with the claim.

        An authentic one that has been issued by a court.
        It should have an issue date, a claim number & be stamped with a seal.
        You can phone the court to check.

          It does state that if you want to defence ornadmit send back to the court is there a way i can upload document so u could see if its real?

                Can you type out what is included in the particulars of claim

                That will give us some idea about what letters to send

                Also , a little bit of history on the loan
                When did you take it out, did you repay and reload or just roll over, if it was just rollovers , how many times did this happen

                While I can offer advice on the standard forms etc to send right now, just how to word your defence is something else. I am positive Charitynjw will also be able to offer lots of words of wisdom as well

                  Thanks for your help ill attach what is said. I took the lending stream in around 2015 paid back many times the full amount and reborrowed and a few were rolled over. Over a period of around 8 months. Ive checked my post and have received nothing from asset collections and investigations to say they are taking me to court. I did notneven realise who they were untill i got this through but they must of bought the debt off lending stream.

                  I hope some of this helps ?

                  What they said was : asset collections and investgstions claim this in respect of an unpaid loan funded by the lending stream. The defendant failed to abile by the terms of the contract. Asset collections &investgstions purchased this debt from the lending stream and subsequently sent a notice of assignment to the defendant to advise.
                  The defendant has failed to respond from the claimant thus denying the claimant the opportunitty in assisting the defendant in attemptingto bring this matter to an amicable conculsion.
                  The claimant claims interest under section 69 of the county courts act 1984 at the rate of 8 percent a year from 16/08/16 to 23/05/17 on £725.20 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £0.16

                    Acknowledge the claim. (See post #2)
                    Send a CCA s78 request + £1 fee to Asset.
                    Are they legally represented? If so, who are the solicitors?
                    Send a SAR to Lending Stream ( Lending Stream, Wisteria Grange Barn, Pikes End, Pinner, London, United Kingdom, HA5 2EX)

                      How many loans did you have from lending Stream before this one that defaulted? Do you know how much interest you paid on those?

                      This defaulted loan, how much did you borrow? What date? how much have you repaid so far?

                      Have you borrowed from other payday lenders as well?

                          SAR = Subject Access Request via the Data Protection Act 1998

                          On the court claim, it gives the Claimant's name & address.
                          Just underneath it gives the legal representative (if any).
                          It is unusual (though not impossible) that a firm is not represented.

                            Just in case it gets lost in the other posts

                            You must do what Charity has said in post 10

                            Acknowledge the claim - can be done online

                            Send a S77 request plus fee to asset

                            Send a CPR 31.14 request to asset ( or their legal representatives if they have one) asking for the agreement, notice of assignment and deed of assignment

                            Also if you answer the questions raised by debt camel she may be able to offer more detailed advice

                              All that it says is asset collections and investigations limited, pobox 1333, blackpool, lancashire, fy1 9ju
