    Hello! Around 2 weeks ago I received a letter allegedly from Monument (Credit card co.) customer services. I know that I own them money from about 8 years ago. So I didn't read it properly - it mentioned a payment break plan and listed a load of outrageous eye boogling charges with a total credit balance of over 3 grand. So I binned it.

    Anyhoo, today I received a cheque from them for over 3 grand. Hmmmm! Right I haven't applied or claimed for anything, so alarm bells are ringing loud and clear! I checked out the Acct No and the Sort code and it does seem genuine. BUT I'm now wondering if this is a genuine repayment for mis-solded PBP or if this they are trying to entrap me into trying to cash this cheque and therefore acknowledging my statute barred debt.

    If anyone can shed any light on this I would be most grateful - I suspect this is to bait me (money out of nowhere, never happens in my world) and to tempt me to acknowledge my statute barred debt and therefore enabling them to chase me again. The cheque is from CCIS LLC with the RBS and the bank account sort code and acct no check out, but I'm sure its not that hard get these types of details. The chance of receiving 3 grand would be nice, but no way is it worth risking my now excellent credit rating!

    If you haven't had any dealings with them in 8 years then the debt would be statute barred (6 years after last payment/acknowledgment) and cashing the cheque or contacting them won't re-open it. Understand your being dubious though so worth looking into first.

    It may well be Monument have had a slap from the FCA under the radar and are making good on excessive charges applied during payment breaks by issuing refunds proactively. Have you had a good scout about the web to see if anyone else has reported similar ?

      Was your Monument credit card account sold on (i.e. bought by a third party debt purchaser) after you stopped paying 8 years ago?

        Thanks Amethyst, that is really helpful. I have had a good nose around the net and cannot seem to find anything similar at least not recent, bar a number of peeps receiving cheques way back in 2014, but as you note there was one in 2016. If genuine I cannot see what exactly they would gain by issuing a cheque? And if fake I'm trying to work out what there is to gain by it going through my bank. Hmmm.. Decisions, decisions.

            I ask because only the current owner of a debt can bring legal proceedings against you.

            If this cheque is from the original creditor to whom you now owe no money (if the debt was sold on) then it may be safe to cash.

            I think you need to do a bit of research just to be safe.

            How much was the negative balance when you stopped paying Monument? Is there a possibility that they could have deducted the negative balance due (from 8 years ago) and then sent you a cheque for the remainder?

            If you want to play safe you could send a Subject Access Request to Monument (now serviced by CCUK Finance Ltd) to get the full history.

            We find 99.9% of clients who come to us saying the debt is Statute Barred are wrong because they forget a one-off sum paid over the phone under pressure from a DCA or through a DMP etc.

            A SAR costs £10 which is a small price to pay if it means you can safely bank £3k

              Brilliant! Thank you Di. There were deductions listed now you mention it - I could kick myself for throwing the letter away. Thank you Di for your super advice - I will ask for a SAR (I will ask prof. Google that one! I didn't pay a cent or reply to any letters after I defaulted and there wasn't any pressure as they couldn't track me as I literally when off grid. Would this be taken into consideration and affect the Statute Barred?

                The SAR should include the letter you threw away.

                Anyway, you need to be sure they got their calculations right in case they owe you more than £3k

                    Although you probably don't need to ask for your medical records or CCTV information (including location)

                    You'll need to edit the template to remove the date period/span because you'll be asking for everything they've got since you opened the account to establish the amount you paid in PBP premiums, the date you last made a payment to the account (for SB purposes) and whether the account was sold on.

                      Just wondering what the outcome of this was? I have received the same thing today! I received a statement with a breakdown of ridiculous PBP amounts apparently making me over £5000 in credit. I contacted Monument and they say I will receive a cheque withing 28 working days. Did you receive a cheque/cash it?

                        Hello I also received a letter without me contacting but I had to send documents if proof of married name I have rung and they said a cheque was raised on the 18 October 2017 and will arrive within 28 days I have telephoned today 1 November 2017 and cheque has not been dispatched. And again said wait 28 days. I find it odd cheque was raised. 2 weeks ago and still not dispatched but the telephone operator said cheques are processed in batches. I would be really grateful if anyone could say if this happened and they did receive the cheque. Many thanks

                          Yes I received the cheque a few days after I last posted but they did tell me it could take up to 28 working days. I'm not married so I didn't have the complication of having to prove my name though.

                            Had a cheque a few days ago from an account I had when posted abroad in the 90's and closed on return to UK.

                            All seems genuine to me.
