    Hi,
    In January this year I used my fathers car to drive to London with my brother to visit friends.
    On our way back we stopped in a Morrisons car park in Stratford.
    I stayed in the car while my brother went in to use the toilets and pick up a few bits for the journey home.
    Not long after arriving home my father received a PCN which we just ignored.
    Yesterday he has be sent another letter headed "Letter before county court claim" it basically states that if we do not pay £100 within 14 days they will issue court proceedings against him.
    My father and myself are now unsure what we should do, do we just pay? Or is there anything we can do to make them go away?
    Any advise would be greatly appreciated.

    So what is the reason for the claim? Has your father still got that original PCN that you can post on here? how many days was it from parking to receiving the PCN?

      The original PCN was thrown away, from what I can remember it received about three weeks from when I parked. It was for not buying a ticket from the machine in the car park. I didn't think I needed one as I was in the vehicle the whole time.

        Received more than 14 days after the event then the keeper is no longer liable, only the driver who they do not know.

          I would reply something like

          Dear Parking Eye,

          I write in response to your letter before action dated xx, the contents of which are noted.

          As the pre action protocols expect us to exchange sufficient information to understand each others position please forward to myself the original parking charge notice and a picture of the signs at the location as well as the operators contract which allows them to operate at the site (or indeed confirmation they own the land in question).

          As well as the information already requested please answer the following questions :-

          What type of car park is it ?

          What contravention gives a cause of action ?

          In what capacity are you pursuing me ?

          Have you followed the rules laid down in the Protection of freedoms act 2012 schedule 4 ?

          Not only will this information help comply with the pre action protocols it will also help achieve the over riding objective.

          Yours etc




          Then i would ask Morrisons to cancel DoNotReply@morrisonsplc.co.uk (yes really). It would be beneficial to have proof of purchase though, probably a bank or credit card statement would be more likely than a receipt.
