    Hi I am in a very simular postion , I have been paying Experto for many years and then in December the Standing order was sent back, I had not cancelled this. I have then out of the blue had 3 letters from PRA , I have today sent them by Recorded letter a request for my CCA form and sent them a £1 Postal order . I find it shocking that they can do this. The debt which I am trying to repay is with MBNA and has fallen off my Credit File over two years ago. I am really worried as besides this I have many other debts but have arranged payment plans with them all and not had the disgusting threats these people are using. Can anyone adivce me what is going to happen next as i do not want to ring these people.

    Can I ask why is the fact Exporto Credito so important, I have been worrying about this for two days. Any advice will be appreciated.

    Hi Jack89,

    How interesting to learn that the despicable tactics of these P aracite's R ecovery A gents imbeciles is being more widely applied......let's hope that the experts here can suggest a way forward for us both such that we cannnot only successfully defend our claims but also expose this "shameful' practice of 'creating' a technical default so as to pursue a County Court Claim in the first case.

    I have reviewed my documents and can at no point find any replacement bank standing order mandate being offered to effect a change of payment account details, simply repeated requests to contact them to 'discuss' the debt. In simple terms a vehicle by which to attempt to extort (through threats/pressure) extra payment amounts off vulnerable individuals who can little afford the sums they would seek during that phone call.....why I was advised NEVER to engage with them by telephone in the first place!

    As if basing an entire business model upon trading on the misery of those already in a vulnerable position were not enough, to then 'create' a default for them with the sole purpose of generating a CCJ under such a doubtful pretext must surely rank amongst the ultimate lows of all time. I can only hope a Judge would regard it as such?

    Whilst I await detailed advice/instructions from those with greater intellect than mine I intend to acknowledge my court claim as kindly suggested by Charitynjw. Maybe like yourself I will be advised to seek the CCA and other documents off this bunch of goons.

    Incidentally, I have also noticed that a PPI was collected as part of my MBNA Card when active not sure if this applies to you as well? .....or indeed makes any difference as my account is in default?

    As others have said....stay strong! So long as these kind people offer their assistance and we share for the benefit of others hopefully justice WILL prevail.

      Hi I have certainly never had a request It is clear to me they are out of order, I have emailed them and they have not responeded , they are the worst type of compnay todeal with and I will informing the BBC and the Guardian

        Hi thank you for the reply, I have so far only recieved a Statement letter,a confirmation of Balance Letter and the letter saying they have purchsed my outstanding balance. I have sent them a CCA letter by Recorded delivery yesterday. I dont know what they will do next. I dont want to ring them.

          You're right not to 'phone.
          If it is necessary to communicate, best done in writing with proof of sending.
          If it were me I'd prepare for possible litigation, just in case.
          A SAR to MBNA will possibly reveal vital info.

            Hi i do owe this money but been paying it back to experto for years without any fuss, do you think PRA have a leg to stand on , the fact experto have gone into ligqidation is not my problem, I wonder if they ever paid any money to MBNA

              A little update I have proof that My CCA Request has been received and signed for by some at the PRA Group, they signed for it yesterday. I have not heard anything from them re my email I sent last Friday.

                Hi I have had a letter from PRA Group saying they have put my account on hold until they can provide me with a copy of the Orginal Credit Agreement or a reconsitituted one . They say if I dont get it after 12 working days, the debt will be classified as Unenforcable until they do get me the Information. They also retured my £1 Postal Order saying this was not. required. I really dont have a clue what will happend next.

                  nice try PRA group you fool no one on here, the court at this stage rules not you1

                  keep to court time table/requirements ignore those idiotic idiots they cannot put anything on hold once court proceedings have been issued

                    Hi Just to clear this up I have not been taken to court yet, I am the second person on this post Had a very intresting letter today from PRA Group . It said that due to the age of the account Varde Experto can not provide copies of my orginal agreement or any statements. They have said they are now classifying the debt as unenforacble . They have said that they will still continue to contact me and ask for payment, They say they will be contacting me agin on the 14th March 2017 to discuss further. I do owe money on this account but wonder if I should email them offering them £10 pm which was what I was paying. Any advice would be greatly appreciated.

                      You will benefit more if you start your own thread where you will get help for your specific issue.

                      The OP (P C Pilot) is managing their court claim on this thread.

                            Are you sure that letter said "Varde" can't provide the original agreement not "MBNA" can't provide it?

                            They've told you the debt is currently unenforceable so why do you want to pay them £10 per month?

                              Hi the letter I have recieved says they have had a response from Varde Experto and that due to the age of the account they are currently unable to provide copies of my orginal agreement or any Statements. I was only saying about making a payment as the debt is still there. I guess I should just wait and see what happens next.
