Insurance Claim - Payment in leiu

Is there any rule that I can request my insurance company (Admiral) settle my claim with a payment in lieu to me,

I had an accident with an uninsured driver and after rejecting my insurers own repairer they have approved an estimate from a body shop of my choice however I asked for a cash payment in lieu but they rejected,

Have I got any grounds to appeal this? Long shot but worth a try, thanks in advance

Probably not!
Although some insurers will pay "cash in lieu" it is normally a smaller amount than is paid to the repairer, and it is generally at the insurers discretion.

Somewhere in your policy wording it will state how claims are settled eg Pay for repairs, replace car or "write off" and pay preaccident value.
So if the contract doesn't include Payment in lieu, Idon't think you have grouds for an appeal through the courts although you could try the ombudsman, if you can bear the wait for a response!

I have checked my policy books it does say the following but I guess they have the final say

"We will decide how to settle your claim and will either:
pay to repair your car, or pay a cash sum to replace the damaged car or item.
A decision will be made based on the garage/engineers recommendation"

I think you're right
"WE WILL DECIDE" is pretty explicit, and they have already refused your request for a cash payment in lieu.
