  • Ccj settlement advice

    Hi,

    Thanks for reading

I was issued a ccj on the 12th may 2016

    I paid on the 11th June 2016

I was told I had 30 days to pay which I did (just) scrambled all my money together every penny to get it paid!

However debt people are now saying they didn't receive any funds until the 14th June

Can I still get this ccj taken off my file?

I have my online banking statement which shows I paid on the 11th?

    Any help would be appreciated

    Thank you

Don't know too much about this but start from this.

How can I remove my County Court judgment held on the England and Wales Register?
A judgment registration is only removed because it was:

    a) entered in error,

    b) paid before the court date,

    c) cancelled because full repayment was made within one calendar month of the judgment date

If judgment was entered in error, application must be made to the court to have the judgment set aside for which a court fee of £255 is payable (payable to HMCTS). If granted the court should notify us to remove the judgment from the register.

From 6th April 2006 when the court are provided with evidence that a judgment debt has been paid in full either before registration or within one calendar month of the judgment date the registration will be cancelled and removed from the register once we have been notified by the court.

You may also apply in writing to the relevant court for a Certificate of Cancellation enclosing:

    a) evidence that the debt has been fully repaid with one calendar month of the date of the judgment

    b) a statement advising that reasonable steps have been taken to obtain such evidence but you have been unable to do so,

    c) a statement advising that you believe the evidence of payment within one calendar month of the date of judgment is already held at the court; and the court fee of £15 (cheque payable to HMCTS)

It's not so much when you paid but when the Creditor receives the money in clear funds.

Thanks mystery I will have a look for a form to send with my bank statements.

Ploddertom I used an online bank transfer which takes 2 hours to reach the receiptant so I know they received it on the 11th, not the 14th which has been entered on the CCJ so hopefully I stand a good chance of getting it removed :-)
