  • Cabot court claim

    Hi. First post here and need some help going further along with this claim made against my partner.

    It's not a special case, a straightforward credit card debt (vanquis) sold on to Cabot who have now made a claim through the county court business centre. It's not statute barred or anything.

    I've got my partner to acknowledge the claim online and send the CCA and CPR letters to the relevant parties.

    Today we got a letter back from Cabot with the what appears to be the standard "we don't actually have it and we pray to god the creditor can actually send us a copy in under 40 days" letter. Nothing from the solicitors yet.

    What next?

      Ok you're on track so far!

      Ignore Cabot's 40 day fairy tale they make things up to suit themselves it has no effect on the court process.

      Cabot has 12 + 2 Working Days to comply with the CCA request and if they fail the debt is rendered unenforceable until the agreement or a compliant reconstituted one is provided.

      Can you please give us the history of the debt e.g. when & why payments stopped?
