    Starting a new thread regarding this court claim.

    £8k debt which they say is now £13k based on 8% interest im 90% sure they legally cant add due to it being a regulated debt.

    Defence Filed. CCA and CPR requested and no response. Pre 2007 CCA credit card. Sold to MKDP then sold to HOIST.

    SB in Jan and default falls off in Feb.

    Can you post up (type out) the Particulars of Claim so it's clear what reasons they are giving the court which makes them feel they are entitled to claim this debt.

    That's the starting point with any claim.

    The Claimant has to prove their claim.

    What stage have these legal proceedings reached? Hearing date?

    Has this £13k claim been allocated to the Fast Track (since it's over £10k) or was it suppressed (by consent with you) so allocated to the Small Claims Court to avoid any costs consequences if they lose?

      Ill have to dig out the paperwork but its essentially just your typical claim for money owed to Barclay Card which they bought from MKDP. Its gone to the fast track i think and they have been granted 30 days stay but they have not paid the hearing fee yet. I got the letter saying that this is now a defended claim etc.
