    Great to find a forum offering help like this.

    My query is:

    if I am dismissed with pilon (and a compromise agreement) does

    My notice period count towards my total length of service?

    So if I commenced employment on 16th Fev 2015 and am dismissed on 25th October 2016 with 6 months pilon, is my length of service 1 yr 8 months or 2 years and 2 months?

    Massively grateful to anyone who can help me with this.

    As I understand it, your length of service would be 1 year 8 months and 1 week.

    If you are dismissed with notice then the notice period is added to your length of service, but in the case of dismissal without notice/PILON it is different. The statutory minimum of notice would be added to your length of service and if you have worked more than one month but less than two years, this is 1 week.

    Does that make sense?
