  • Lowell Financial Ltd Pre-Legal Assessment letter

    Hi Everyone,

    I have already received some great advice on the forum on a different thread and am hoping to get some help here too.

    I have today received a Pre-Legal Assesment letter from Lowell Financial Ltd (even though it is dated 16th August). It states that they intend to take legal action if I do not contact them to agree a repayment plan. It lists what legal action means and then states that they would prefer to work with me without taking legal action.

    I do not recognise original company name but think it may relate to a store card I had.

    It says I need to contact them by 30/08/2016 so I haven't got much time. Can anyone help please?

    Have you received any previous letters about this?

    If this is an old store card debt , do you think there is a balance outstanding?

    When (roughly) did you get the store card?

    When (roughly) did you last make a payment to it? Is this store card debt showing on any of your credit records?

      I haven't had any previous letters about this. They say that the debt is over £1000 but I thought it may be around £700 (guessing interest is added on?).

      I think it was opened around 15 years ago but last made a payment around 4/5 years ago when I was made redundant. I haven't checked any records as yet so not sure.

      Do store cards work in the same way as credit cards with regards to making a CCA request etc?

        Yes they do. From what you have said the debt won't be statute barred so asking for a CCA agreement is the right thing to do.

            I've sent a CCA request. Should I now just wait or should I request further documents? Any advice would be great!

              Good morning,

              I take it Lowell has not yet issued a claim?

              Lowell has 12 + 2 Working days to comply with the request. If they fail to comply the debt is rendered unenforceable until the agreement or a compliant reconstituted agreement is produced.

                  Hi again. I have received another letter from Lowell today:

                  Pre-Legal Assessment

                  We will take legal action to recover the outstanding balance if you do not contact us to advise why the account has not been paid or agree repayment. You can set up a repayment plan by registering...

                  Legal action means that a claim form will be issued by the court demanding payment of the debt.

                  It will also result in fees and interest being added to your account, which will increase the amount you owe.

                  To avoid any further recovery action, we're prepared to write off 20% of your balance, if you set up a repayment plan by 14/09/2016...

                  I have sent a CCA request, could it be that it has overlapped with this letter? Any advice?
