  • Lowell Solicitors Ignored CPR & CPA

    Hi there I was hoping I might be able to get a bit of advice. In January this year I received a county court claim for a claim that Lowell Solicitors have made against me. The debt is apparently a vanquis card that I supposedly took out in 2013. I responded to the court stating my intention to defend in full and on 16/2/16 I send a CPR and CPA request to Lowell Solicitors. With the £1 postal orders and recorded delivery. I have heard absolutely nothing since until today 19/08/2016 where they've written to me saying pay the debt in 7 days or they'll ask the court to issue the judgenent against me. They haven't responded to my requests for 6 months will that case even still be with the courts? Obviously I don't want to ring Lowell's so I'm just wondering what to do for the best at this point? Any guidance would be greatly appreciated. Many thanks

    There are some important bits missing in your narrative.

    Did you submit a defence?

    If so, could you give us an idea of what has occurred re the court timetable/directions to date?

      As Charity says, what happened after you acknowledged service, did you enter a defence?
      Without the agreement ( If you have defended ) the debt cannot be enforced but without a defence filed in time they can get judgment.

        Hi thanks for the reply. Sorry I'll do my best...

        I received a ccj claim form from the court in February this year. Lowell's Solicitors acting on behalf of Lowell portfolio made a claim against me for £636. I logged into money claim online and I either submitted my defence or issued my intent to defend (I'm not sure what box that was in it was a while ago) on the basis that I didn't recognise the debt (vanquis originally) and that I had sent off a cca and CPR. I sent the cca and CPR to Lowell's and Lowell's Sol's on 16/02/2016 via recorded delivery and sent the postal orders as advised on this site. I have had absolutely no correspondence from Lowell's portfolio or solicitors since that date. Today (6 months later) I received a letter from Lowell Solicitors saying that I "have failed to respond with a proposal of payment or why the debt is disputed". They say if I haven't made an arrangement by 25/08/2016 they will ask the court to issue judgement against me. I have never received a response to my cca/CPR requests from Lowell portfolio or solicitors not even an acknowledgement. I have tried to log in to money claim online today to check the status of it but I get an error saying that the claim number or password are incorrect. I'm not sure wether to contact the court by phone or respond to Lowell's.

          Did the court acknowledge what ever it was you posted on MCOL as a defence?

          You need to phone the court on Monday to find out what exactly has happened.

            Hi no I never received anything from the court to acknowledg my acknowledgement. I've just been thinking back and I'm sure I filled in the form that came with the letter and posted it back. I only logged into mcol to check if the claim was actually genuine sorry I've only just remembered that part. thanks for coming back to me I will ring the court first thing Monday and find out where it's up to with them. Then post here if that's OK thanks again have a nice weekend

                I have copies of the CCA and CPR that I sent. I emailed them to myself the day I went them so prove the date they were written. They were all sent via recorded delivery. My Mrs needs to dig out the receipts as it was six months ago but she's pretty sure she knows where they are. Cheers
