    in april a 16 year old is told that she has the job she has interviewed for working saturdays in the local leisure centre.. the centre is run by a limited company. she has a dbs check as requested by the company and takes it into work. however. despite several requests to the duty manager she has not been given a contract.. despite several requests to the duty manager about the correct forms to sign to receive payment for the hours worked she is told she just needs to sign the sign in book.. she is also told by the duty manger that she will receive her salary at the end of the month (i.e. may). she has not been paid.

    SHE COMPLAINS TO HR.
    hr have said that they have no record of her that she ,doesnt have a contract and she hasnt signed a time sheet and they pay one month in arrears.
    i would be grateful if you would advise what action i should now take on her behalf.

      hi leclerc She started training and working there in april. the duty manager said that she would be paid for training.

        Are you sure it's not monthly in arrears, meaning payment is made at the end of the month when work commenced, depending of course on how quickly it takes to set up a person on the payroll.

        If there is no record of the person, what has happened to the bank details etc that should have been submitted within the first few days to enable payment to be made?

          she has completed a dbs form the duty manager took a copy of the original for the files.
          she completed the form the duty manager gave her asking for the usual details including bank account details.
          she was asked to start work on the following saturday
          she was then told by the duty manager that she would receive a contract and every week she asked and every week they promised and no contract.
          she has been working since April and not been paid

          What action can i take on her behalf please?

            I have checked all the timesheets for April and cannot find one for you. Please can you confirm when you handed it in and where it was left.

            Also, we are currently processing the timesheets for work completed in May, and there is no timesheet for you for May either - was one submitted?

            Timesheets need to be submitted by the last date of each month and then you are paid a month in arrears. So if you completed work in May, you will be paid for this at the end of June, as long as the timesheet has been submitted on time.

              she has been working since April and not been paid
              If the HR now know about her, when do they intend to pay her, and do they intend to pay from the start of the training period? If so, they should be processing a payment now, albeit 11 days late and a further payment to be made at the end of June. Has the person completed belated timesheets for April and May?

              I've never come across an employer that would make someone work two months before receiving anything. I suspect the system is monthly in arrears, rather than one month in advance. That would mean (at worst) the part of April and the whole of May should have been at the end of May, but at best (and depending on when the April start date was) a payment in April.

              Also, within two months of an employee starting work the person must be provided with a Written Statement of Terms and Conditions of Employment. Has this now been provided?

              It looks to me like this person has either been fed a pack of lies by the Duty Manager or has misunderstood what she has been told. Was anything written down?
