  • Lowell/shop direct court paper ...what next

    Hi this is my first post however i have done lots of reading on here and hope you guys can help ☺

    Been getting letters from lowell for ages and stupidly ignored them. Please dont judge me ....I was in a violent controlling 10yr marriage during which lots of debt was run up - i fled the home with my kids and tried to build a new life...after a breakdown i really dont even know what half the debt is and a certainly cant afford to pay it

    So thursday 12th may i got some papers from court ... typical bw legal acting for lowel.

    Friday 13th (just my luck) i acknowlaged online with the courts

    Sat 14th may i sent the 'prove it' letters from your lovely templates to both lowell and Bw (and my £1 to lowell)

    To date i have heard nothing .... soooo what now ? Do i just let them not reply and then add my defence ?

    Hi welcome to LB,
    Can you please post a copy of the claim for N1 after removing the claim No. and your personal details.

    Lowell has12 + Working Days to Comply from the date they receive the request. Did you send the request by signed for post.

      Will add pic of form in a bit once im home, yes sent recorded and kept recipts. If they dont reply do i just leave it - do a defence and put in there that they havent supplied any documents that i requested

        You must complete all the papers that are issued by the court, each stage is time limited.
        you have 28 days from the date the claim was issue to file your defence, any statement by the claimant and or their solicitors that the
        " matter is on hold" should be ignored unless a formal extension of time has bee n agreed between you and the claimant and You have notified the court about it.

            Hi i cannot upload any pics ? I recieved a letter today from BW LEGAL that says

            'We acknowledge recipt of your letter dated 13th may, the contents have been noted.
            We are currently awaiting documentation which has been requested from your original creditor. We will try to provide these documents as soon as possible but this is contingent on recieving the documents from the original creditor within a reasonable timescale'

              Hi,

              If this the response to the CCA request if they cannot supply the agreement within the statutory 12+ 2 working days timescale the alleged debt is rendered unenforceable Until the agreement or an compliant reconstituted one is produced.

              This does Not stop the court processes so make sure anything from the court is dealt with promptly.

                This is in reply to the CPR 31.14 .... iv had no reply from lowell yet

                I have done my acknowledgement to the courts on 13th may (papers issues 10th)

                  Hi - I still can't find out how to upload my picture of my court papers and the letter off BW sorry - ..my court papers where issued on the 10th may and I responded on the 13th ... what date is my defence due please ? I have had no reply from lowell to date and only that 1 letter off BW so what shall I do now please?

                    33 days from date of issue ... we usually use this site to check dates - http://www.timeanddate.com/date/dateadd.html

                    1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
                    You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

                    2: Send A CCA REQUEST to the CLAIMANT ( see here )
                    This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


                    3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

                    This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely) You can include a copy of your CCA request with this letter for information.

                        I spoke to BW today who told me the account is on hold and that letter they sent confirms it ? So how do I go about getting an extension from the court ? The guy told me that letter ment it was on hold?

                          The extension has to be agreed between the parties, and, as BW Legal well know, there is a maximum extension available of 28 days. If they generally said 'your account's on hold' then that isn't an agreement for an extension, so put your defence in.
