  • OLD CCJ

    Hi

I recently discovered I have a CCJ on my file. I managed to find out through Northampton CC its for Capital one via Arrow Global. Its for £1151.
    It was registered in 05/2014.

I have never received any paperwork from court, Capital one or even Arrow Global.
The Capital one default itself dose not appear on my credit file.
Ive always lived at the same address.

Im not being chased by anyone.

Dose anyone know whats going on?
Is it worth me going to court and paying for the n244 service to set the judgement aside?

I have copied and pasted below what the court sent me when I queried it.

    PARTICULARS OF CLAIM

    1. THE CLAIMANT'S CLAIM IS FOR THE SUM OF 999.00 BEING MONIES DUE FROM THE DEFENDANT TO THE CLAIMANT UNDER A REGULATED AGREEMENT BETWEEN THE DEFENDANT AND CAPITAL ONE (EUROPE) PLC (NO. 4775xxxxxxxxxx) AND ASSIGNED TO THE CLAIMANT ON 11/02/2011, NOTICE OF WHICH HAS BEEN PROVIDED TO THE DEFENDANT. 2. THE DEFENDANT HAS FAILED TO MAKE PAYMENT IN ACCORDANCE WITH THE TERMS OF THE AGREEMENT AND A DEFAULT NOTICE HAS BEEN SERVED PURSUANT TO THE CONSUMER CREDIT ACT 1974. 3. THE CLAIMANT CLAIMS THE SUM OF 999.00. 4. C HAS COMPLIED, AS FAR AS IS NECESSARY, WITH THE PRE-ACTION CONDUCT PRACTICE DIRECTION. NUMBER

      Hi welcome to LB,

This would appear to be a judgement by default.

I presume you did have a Capone account?

      nem

When was the last payment or written acknowledgment of the debt?

        Hi Nemesis45, thanks

I don't actually having recall having a capitalone account.
Look at a credit report from 2008 I can see capital one listed as one of my creditors.
I cannot say for sure but I have not received any letters or spoken to capital one since 2009 so I don't think I would have acknowledged anything since then. I don't even know how the default came about in the first place

So, the claimant is stating (actually & by implication) that they/Cap 1 have sent you at different intervals
          Statements of account
          Default notice
          Notice of Assignment
& possibly Debt Collection Agency letters

The court has sent a court claim pack.

But you haven't received any of these?

Nemesis are you able to see from the registry trust info I pasted whether the debt was statue barred when the claim was issued?

                    regards
