  • Cabot UK issued ccj, where they allowed?

    Hi all, followed up from a previous thread I finally got Cabot to send me a copy of the letters saying I was being taken to court for a unpaid loan from 2006.
    So it was Cabot UK and it was issued one year ago this week.
    Now I have read alot that Cabot UK did not hold the correct licence to be able to case customers down for debts and issue court proceedings.
    My other problem is no sooner had I found out I owed this money I started paying it back.
    So technically I have admitted to owing the money. I believe this causes problems when getting them set aside. I actually could pay it all off in one if needed and could have done back then if I had know about it.
    What are my chances of getting this set aside.... Do I have any grounds to appeal or am I as they say........stuffed

            Arses, well yes it would seem that a set aside application wouldn't get very far.... although you didn't receive the papers, you hadn't told them you'd moved, or set up a redirection, and you don't have a defence to the claim ( well that's a presumption on my part really as you said you wanted to pay it off and have been making payments) - if you can settle in full you could TRY and get the claimants to agree to a set aside on the grounds you make payment in full.... not going to be a walk in the park though and they will more likely want to just mark the CCJ as settled/satisfied.... then you could get a certificate of satisfaction from the court to show to your employer? (if that would help?)

              That's a pain..... Can Cabot ask to have the Ccj set aside? I thought it was only the defendant who could apply for that

                No, it is only you who can apply, but you MIGHT be able to convince them to allow you to apply to set aside and they consent to your application, under a private agreement that you pay them in full as soon as it is set aside - a VERY LONG SHOT as as soon as you get the CCJ set aside they lose security, so would have to put an agreement in place..... hence much more likely they'd agree to mark it as satisfied as soon as you have paid it. Does you employer need a completely clean file, or just nothing outstanding ? The CCJ will show for the full 6 years but show as satisfied.
