  • POPLA Appeal - help requested!

    Hello, and many thanks for helping people like me!

    I have received a Parking Charge Notice from MET Parking Services, telling me that I exceeded the allowed time parked at McDonalds, Milton Heights, Didcot on 31st August 2015 (118 minutes against a limit of 90 minutes). They dated the PCN with 7th September, but it looks like they sat on it for a while, as I received it on 16th September.
    I used your fairly straightforward letter to invoke the appeals process. They rejected the appeal (dating the rejection 29th September, but again it seemed to take a while to get to me), and gave me a POPLA reference as I had requested.

    I'd be very grateful if you can help me with some text for an appeal. I've seen your "New POPLA Process" blog post, and think I can follow the instructions, but obviously it's that all-important appeal document that I'm missing. Is there anything resembling a template for the appeal, or do we all just ask you to construct something for us as individuals? Either way, I'm very grateful for the help you provide.

    The rejection came in an envelope, do you still have it and does it have a date on it ?

      Unfortunately, I slipped up, and I don't have the envelope or a record of when the rejection message arrived. It definitely didn't arrive before Monday 5th October, but I can't say more than that.

          There was no date showing on the PCN envelope. I made a point of looking for that, but all I can say with certainty is that the letter arrived on 16th September.

                      That explains entering a popla appeal quite well.

                      You only get one shot so enter everything at once. You may need to convert to pdf, i'm not sure on that.

                        I have today received an email from POPLA saying:

                        We have now received the case file from MET Parking Services and this is available for you to review on the portal.
                        You have seven days from the date of this correspondence to provide comments on this file. This can be done directly on the portal. Any comments that you make after this time may not be considered as part of the Appeal process.
                        Once this time has passed we will progress the Appeal for assessment. We will let you know when this happens.
                        **

                        However, when I looked on the Popla portal, the only message was :

                        **
                        The operator will send the evidence independently
                        Verification Code
                        xxxxxxx
                        Operator Name
                        MET Parking Services
                        Operator Case Summary
                        The operator didn't provide a case summary
                        **

                        Presumably this means I will receive something in the post? Or do I need to count the days and then submit a comment to say nothing has been received?

                        Mild uncertainty here, but I guess you've seen it all before.

                            Evening,

                            MET Parking sent their material to me today.
                            I've attached a couple of files showing their submission.
                            I'd be very grateful for any further advice as to what to do!

                            POPLA emailed me at lunchtime on Monday 16th, giving me 7 days to respond.

                              I would like to respond to the operators evidence as follows :-

                              The letter of authority is dated 2013 and offers no hint as to the duration of any period which may be covered.

                              The operator claims that the signs indicate a time limit for a stay rather than time parked. PoFA 2012 schedule 4 paragraph 9 is not optional so in that regard it makes no difference what the signs do, or do not say.
