  • Gate attached to our property.

    We have a detached property which is rented out. The tenants now wish to buy the property. However, they have advised that our neighbours wrought iron gates cause vibration and noise when they are used. They have asked if we can get these removed prior to a sale going through. The gates have been up in excess of 8 years and as we never lived their obviously there has been no issue for us. We would have given verbal agreements for the gates to be secured and screwed into our property. Can I now rescind the verbal agreement and ask the neighbour to remove the fixings from our property. I do not want to lose a sale and at the same time I do not want to cause a dispute as the gates have been there a long time. Could the tenants request the removal when they buy?

    You could end the verbal agreement I suppose with reasonable notice 14 days or more usually suffice subject to any rights the neighbours may have. However I don't see why the new owners are wanting the gates removed prior to buying. Unless there's something registered on the land registry in relation to the gates (their solicitors should know if this is the case or not) then it is a verbal agreement between you and your neighbour. As the new owners are not party to that agreement they will have a right to request removal of the gatesOnce they become legal owners of the land/property.

      Well, it's in no way an easement, given any interest in land must be created in writing. Simply write to the neighbours requesting the gates' removal.
