  • How to deal with a solicitor who has a bad attitude? - PART II

    Hi all

Following on from my previous thread about 'how to deal with a solicitor who has a bad attitude?', I am afraid I need more help about dealing with THIS solicitor.

Currently, it has come to the final stage of purchasing my new house, and I am all ready to exchange the contract with the developer, but something has happened.

About a month ago, I went to see my new house on site, then talked to the sales guy there for an update of the legal process. I told the guy that I had heard nothing about the contract exchange, so I asked him if it was something wrong in his side. Apparently, it turned out the developer's solicitor was waiting for my solicitor to exchange the contract. I was shocked and embarrassed about the situation. Anyway, I contacted my solicitor to ask what was going on. And only at this point, my solicitor decided to send me some legal documents to read and sign. I was really not impressed with the service!

Anyway, I spent a weekend to read through the documents, then I discovered on one of the documents my name was written in wrong order - middle name + first name + family name. I thought what the F was wrong with this solicitor. So I contacted the solicitor again and had a big drama about how on earth my name was wrong on a legal document. I heard no response, apology or whatsoever from the solicitor. Then two days later, I received a revised document with my correct name on, how difficult was that to get it right in the first place?

Finally, I signed all paperwork and posted the whole lot back to the solicitor by special delivery. I expected the solicitor at least informed me to say she has received the post, but again, nothing from her at all! I waited 2 days then I wrote to her to ask if she received my post. I didn't get a reply so I waited another 2 days and asked the same question again. This time, I received a reply from her saying, 'Not yet – will chase again tomorrow. Just waiting for the authority to exchange.' I had no idea what she was talking about. In the end, I could only get the info out from the sales guy that my solicitor needed to re-submit the paperwork to Orbit (help to buy agent) because of the error of my name previously. And from what the sales guy understood, my solicitor has not sent the form back because she was waiting for a missing info from Orbit, but Orbit will not release the missing info until the revised form is submitted. The whole thing seems a disaster to me. My solicitor has no idea of what she is doing!!

And now, my help to buy loan is expired today, I have still heard nothing from the solicitor, I am very angry with the crap service that I am getting here. Therefore I just wanted to know what consumer right I have got here to complain against this solicitor. Can I go to a legal ombudsman or something to report her?

    Many thanks in advance

The proper process is a Formal Complaint to the Legal Practice,
if your solicitor is a partner or an employee of a practice.

If the solicitor is a sole trader, you should formally raise
    your concerns with her directly.
