  • Cabot Financial help needed please

    Hello all, I am new to the forum and would like some help please. Sorry in advance for the long story.
    A few months ago I received a ccj claim from Cabot about a credit card debt for £1400 , I know I did owe some of the debt so I panicked, part admitted and sent the forms to the court. I then sent a cca request to Cabot to which they have failed to respond to.
    Anyway, after I calmed down and had time to think I realised that in 2012 I had a Ppi refund on the card and recently claimed back charges so I write to lloyds about the refund. I received a letter from lloyds stating that they have refunded me charges and paid off the credit card and my balance is zero and had what was left over paid into my bank account. The letter lloyds sent me said the debt was with apex and they requested the account to be sent back to lloyds so they can clear it. I phoned lloyds today to tell them the account was actually with Cabot. Lloyds told me that it is not with Cabot and they can't understand why Cabot is sending me letters. Lloyds told me the debt is with apex and not to worry because the account is cleared and to ignore any letters from Cabot because they do not own it.
    i phoned the court to tell them this and they have told me that's probably why they haven't responded to the claim and it is now stayed. The court told me to keep the letter from lloyds as proof in case Cabot try to restart the claim.
    so basically I've been stressed out to my eyeballs, worrying and losing sleep about getting a ccj from Cabot. They have taken me to court and put a default on my credit file and they don't even own the debt.
    I was just wondering how I get the default off my credit file and would it be worth claiming for damages

            Hi, If the account did actually go into default, even if it was paid off by a later refund or repayment it does not affect the credit file entry other than it should be reported as satisfied.

            Apex is Cabot's debt collection arms trading name, which is used to collect and manage debt Cabot has bought. Meaning in my opinion either ( or possibly both) Lloyds and Cabot have got themselves into a situation where they don't know what is fact or fiction.

            Cabot did Not originate the entry on the CRA files this is entirely Lloyds responsibility, all Cabot can do is update the file with it's company name as allegedly the new owner of the debt.

            " Damages" is another matter entirely you would have to be able to prove actual financial loss or disadvantage caused by the entries on the credit files, a very difficult matter to prove.

            It is a question now I think of Formal Complaints to both Cabot & Lloyds about their conduct in dealing with
            the alleged debt.
