    Please can someone explain in simple idiot terms the name in which proceedings should be brought in the following case. I realise the importance of using the correct names and that claims are often brought by/against parties who have been incorrectly named: -

    Sygma Bank commenced proceedings in County Court for JJB credit card debt, however as far as I can see Sygma Bank has never held a Consumer Credit Licence but Creation Financial Services Ltd (which is one of its trading names) holds a licence.
    The Credit card statements state CREATION, but state underneath the word CREATION "your account card is with Sygma Bank UK
    Given that SYGMA doesnt hold a Consumer Credit Licences should the claimant be shown as Creation and not SYGMA BANK
