    Good Evening Everyone,

    Just to give some background information to my circumstances as this has been going on for a few years now.

    In August 2012 my partner and her cousin were in Whitby for a few days using my car. They parked in the CO-OP car park and overstayed the allocated time by 11 minutes. Thought nothing of it until I received a PCN saying I owed £90 but if I paid within so many days then it would be £45. Did some research at the time and the advice was ignore these letters as I wasn't driving the vehicle and was not required to disclose this information. Over the next few months/years I kept receiving various letters demanding money and threatening that this debt was escalating and would be signed over to a debt recovery agency. I kept ignoring these letters as thought they were using scare tactics to try and get me to pay.

    In my current job I often work abroad and a few months ago while I was out the country I received a letter at home (which my partner opened and rang me about) saying it was a claim form from Northampton County Court. The claim form was NOT an original document and was clearly a photocopy with a suspicious looking County Court stamp on it. The amount claimed was £130, court fees of £35 were added as well solicitors cost's of £50 giving a total amount claimed of £215.00.

    As I was out the country I told my partner to ignore it as it was a photocopied document and I would deal with it on my return. When I returned home and seen it I decided it looked like a fake and again they were just trying to use scare tactics to get me to pay. Again thought nothing of it until this morning.

    This morning I received a "Judgment for Claimant" (in default) letter saying I had not replied to the claim form and therefore must pay £130 for the debt and £107 for the cost therefore a total of £237.00.

    Again it does not look like an official document and again has a suspicious looking County Court stamp on it. It gives the address to make payment to as Debt Enforcement & Action Limited, Horton House, Exchange flags, Liverpool, L2 3PF.
    It also states that details of this judgement will be entered in a public register.

    I have checked on http://www.trustonline.org.uk/ and there is no record of this on my file. Again I think this letter is a fake and they are just trying to scare me into paying.

    Do you agree?

    Hi welcome,

    The company has a high profile on the internet.
    Please post here a copies of the documents you
    have received?

    You can always check the validity of this judgement
    by calling the court named on the judgement order.

      Fairly certain you've screwed yourself. If in doubt about court papers a quick call to the court will reveal all.

      You want to find out if you still have time to pay before you have a CCJ on record for 6 years. Setting aside a judgement you ignored will be difficult.

              I am not 100% sure who sent them, because they were poor quality documents which looked like photocopies I presume they came from the enforcement company.

                Hi Andy,
                The documents certainly look genuine and the claim seems to have been passed to the Barnet Courts for enforcement, probably why the photocopies are poor.
                Let us know when you have phoned the court.

                  I have just called the County Court Money Claims centre and quoted the claim number. It is a genuine claim. The lady on the phone said the only details she could give me where that it was in relation to a parking fine and was between myself and Debt Enforcement & Action Limited.

                  What are my options now?

                  I feel a bit annoyed at myself for ignoring the initial claim form but like I said earlier I was out the country when I received it. Also I may have been naïve in thinking that court documents would be originals and not photocopies.

                  I can pay the amount straight away no problem, I could of paid the initial parking fine but it was the principle of the matter! Also do you think because they made a spelling mistake that makes any difference?

                    No the spelling mistakes are not likely to help you.
                    Yes you can pay and if you are within 28 days of the
                    date of the judgement then no CCJ will be recorded.
                    Get a receipt from the enforcement company and ensure
                    that they inform the court that the debt has been satisfied
                    and do the same yourself.

                      The date of the judgement was 27th April so this gives me 28 days from then to pay.

                      Not worth trying to get the judgement set aside?

                      In your opinion just bite the bullet and pay?

                        I think considering the amount and the cost of applying for set aside £155.00 and no guarantee of success "bite the bullet" and pay.

                          Sometimes they must set aside and in other situations, as i believe yours is, they MAY set aside.

                            I think I will just pay it. As much as it annoys me to do so it gets the matter dealt with and a line drawn underneath it.
